Can someone please tell me if I’m overreacting and/ or misunderstanding this. Imagine an 8 year old girl telling DCS in a child interview her step cousin several years older (12) put his private in hers. And then the detective telling you the other parent “we need to get consent from the boys father to talk to him. If he refuses then basically the case closes” I want to add the 8year old girl is not in that house or around the boy anymore so she is not in danger of this happening again. But this is what the DCS detective told my boyfriend. I am LIVID. I feel like he basically is saying if we don’t get any proof or be able to talk to the boy then nothing comes of it. Like is what she told them not important enough?!

It should absolutely be taken seriously. Lesser accusations have destroyed families when made against a parent. Seek help from a family attorney who practices law in your area and take on dcf case. Best advise I can give. Also, if this is your child seek medical attention immediately and counseling. Exam can tell you if there has been penetration, but not if it's was just touching. Seek help fast!!!

@itsfeeeneyyyyy If you don't object I will continue calling her your daughter. She may not be yours biologically but in my way of thinking she is yours bc you lovebher and are with her dad, and you're trying to protect her. I'd make a police report and get am attorney. The strongest evidence you'll have us that adults eyewitness testimony. Your attorney will help you make the best next steps. So sorry this is happening! Definitely something worth pursuing!!!!

You can open a police case 😬 they would still need guardian approval to talk to him, but they wouldn't drop the case just because the guardian said no. You know how many sexual misconduct cases would get thrown out the window all because there was no consent to talk to minors? If possible, still go ahead and get the exam done, it might be too late to show penetration took place at the time it did, but they could probably check to see if hymen is still intact (although, it could break outside of sex), this could help to get her taken seriously about the encounter she described. At a minimum, she needs counseling

an exam has been done with DCS and another will be done with her doctor. That is was was being referred to as far as too much time has passed. It’s been 6 months since the incident. They said they didn’t see any sign there had been penetration but to follow up with her doctor. They said it’s possible because of how much time has passed any evidence has been long gone. DCS was contacted when he found out and now thanks to these lovely ladies and in my previous comments you would have seen the cops are being contacted. I wasn’t saying it’s too late to file charges.

Well that’s why DCS was contacted. We didn’t know what happened. And thought they could do something. Their child counselor got more info out of her than anyone else. So it helped but obviously this is going to go to the police now with this new info.

I don’t have any advice but I just wanted to say that she is so lucky to have you advocating for her. This happened to me as a child and my parents only found out about it a few years ago now that I’m an adult.

I haven’t read all the comments so I’m only replying based off what’s in your post. I don’t understand why they won’t speak to the boy unless you have state laws that are different than mine. Here DCS does not need parent permission to speak to kids... at all! In cases of suspected sexual abuse (including kid-to-kid), the caseworker will come to school. They contact parents letting them know they are taking temporary custody of the child, then they transport them to the DCS office where a specially trained caseworker interviews the child. The child is then returned to school and the temporary custody period ends. DCS needs to do a forensic interview with this boy. I’m appalled they would need parental consent to proceed with this! Are schools open in your area?

I didn't read comments. But if that "detective" doesn't do his job correctly than I'd ask for another one. My best friend is going through this with her kids & sister. Sadly it was their own father & uncle to her sister by marriage. But there wasn't any physical proof but the girls have all said what he's done to them and he is being tried and there is going to maybe be a trial if he doesn't take the plea deal if he's given one. Do not let them tell you that this is just a push over case because "the detective" doesn't want to do his actual job. Those kind of cases take more work and more looking into. My friends case has been going on now for about 3 or 4 months. And she just now heard that they have a case and it may go to trial. The cop could just be lazy not wanting to do his job . I'd definitely have it pressed . Also you can call her doctors and have her checked out to see if anything could be messed up or anything else wrong. They can normally tell on smaller kids than adults. Poor girl...
