Health insurance advice please...

When my son was born, I was covered in my mother's health insurance, but my son wasn't. He had serious medical issues and instead of his insurance getting billed, they billed my mom's. My mom's insurance paid his bills and now, two years later, they want their money back. It's a large amount of money and we've contacted both hospitals he was treated at, his insurance company, and they're all saying it's too late. My moms insurance just got cancelled. Does anyone have any advice.

They need to be contacting the hospital to collect the money they gave to them and not you! It's not like you received a dime from them anyways.

Sorry to hear about your son ☹️.

I would definitely suggest talking to a lawyer. It sounds like negligence on the hospital's behalf. I don't get how your mom's insurance is even being billed given that your son wasn't even insured with them at all. Shouldn't the insurance company know it he wasn't under them? Why should they even have a record of him at all? That sounds odd.

Thanks for the responses. My son had Medicaid. He passed away, but I still had his old card to give them information. He was covered from birth. My mom is going to try to consult a lawyer.

I would give them the other insurance companies info and refuse to pay anything since it's been so long. After 2 years they know that the other company won't pay and it sounds like they are just trying to get money out of you.

This is why I'm glad I live in Canada. I remember you and I can only imagine how upsetting this is for them to bring to you now. I'd say contact the hospital again since they are the ones who billed the wrong insurance and see what they can do, they cannot expect you to pay when he WAS insured.

Yikes! So your son had his own insurance at the time? This is definitely the hospital's mistake. Unfortunately like pp stated, after 1 year it is too late to send the claims to the other insurance. I'm hoping the hospital doesn't try to bill you, I would refuse to pay for their screw up. Does your son happen to have insurance through Medicaid? If so, at least where I live, it would be illegal for them to bill you directly.

When I had my youngest two my insurance company covered them for the first 30 days. If I wanted to continue coverage with that company for my kids I could, or I could cover them under a different company. Do you have a copy of the insurance company's policy? You can probably google it if you don't. Read the policy and see what it says in regards to coverage of infants after birth. Hope you are able to get it straightened out quickly, insurance companies can be a pain to deal with.

I work in medical billing and providers have 1 year from the date of service to file their bills with my company. I'm on the insurance side of things and if the year has passed we won't pay it. You could possibly argue that the bill was submitted within the 1 year but it went to the wrong insurance company. I would definitely call and try to work with them and find some other options.

What about calling your son's insurance company and having them try and settle it with your mom's insurance company? That's all i can think of that might get you a few answers.
