So its been 3 weeks since my boy was born. non complicated, no bad tears, etc. vaginal birth. I had an epidural. I told the doctors multiple times, " My body is very resistant to pain medication and anesthetics." and he didnt listen. he used the numbing stuff once, went to put it in my spine, pain. He pulled it out and put it back in 3 times before he realized that the numbing stuff was only gonna work after giving me a bit more then normal people. Now? Every now and then I have pain that stens from the spot they put it in, shocks up my spine, tightens my upper back to lower back, and it feels as if something is wrapping around my rib cage and compressing it, and my lings stop working for a minute or two. the pain almost goes into my chest, but stops right before. Can I sue for malpractice? Im not happy that I have to deal with this. I cant be carrying my newborn and suddenly fall over in pain because a Doctor didnt listen.

I just needed to know if I can do anything about it. The most I know is it is nerve pain.

I'm having the same issue as you. I had my baby about two weeks ago, and with my other epidurals the pain was never this severe. When I got the epidural this time she kept messing it up and I actually ended up passing out from the pain. My OB has sent me to a pain specialist and they have started me on pain medication as well as trigger point injections, and ordered x-rays and stuff on my back. I would say before looking into a lawsuit go see a doctor.

@micahsmama, nerve pain can also mean the nerve is still irritated from having the epidural right there. Malpractice would be if you continue with having issues further down the road. But you can't sue military doctors hon.

So what can I do if it was their fault, can I go after that doctor for malpractice.

Nerve pain means he either nicked a nerve, or something more. Which means he fucked up.

I would get seen first. I had the epidural and my back killed me for about the first month after. I went back to make sure I didn't have any leakage in my spine. All was good. I'm 7 weeks pp and to this day every morning and night my back will start to hurt. During the day I'm fine. But yours does sound more serious so if get it'd checked then go from there.

More than likely they'll just say it's from the epidural since it "causes back pain" and other complications. I had no issues with my first two in TN but my one last year in GA my back was tender and I could barely move it in a certain direction for almost 6 months. I would have to stretch before I could get up

Well you would need to be diagnosed with something before anything else. And if you gave birth in a military hospital you cannot sue them. I'm sorry you're in pain. I'd try to get seen when possible to make sure it's from that and not something else.
