yes, but where I'm from, once you go to take him for child support he can also fight you for rights and once the baby DNA comes back positive to him he can fight to have the babies last name changed!

If you are not married you have full control of babies name, and baby decisions at birth and so forth. They will not ask the father, they will ask you. He must pay child support, there is no maybe, and in some cases this may lead to a DNA test and if he is the father its the same story. He has to pay child support. You are solid.

yes you can put whatever on the birth certificate you want but in some states he has to sign to be put on the birth certificate as father with a witness. So if he gets mad about the baby not having his last name he could refuse to sign.

Regardless if he fights for the babies last name to be changed, or not, there is also still the case of who is the most proper parent. It might be hell if he fights back, but go for it mama, all in.

best to check with your state but your the mother so what u put on the certificate is what's suppose to b and if down the road his dad and I get back together or u marry someone else you can change their last name but y'all will still have to go to court and if his dad says well the baby should have my last name u can change it that way too and honestly that's what I would do if I was the dad and was going to b giving you child support for the next 18 years and it's a boy I'd want him to have my last name but I'm a fighter so I'd take u to court either way and everyone is different

he can have paternity taken yes but had no say over the name only mom does maybe not all the states but you can Google it he cant make you give your baby his last name and especially since you're not married. the only way he can is if he gets custody and you sign your rights away

Are you married to someone else? because in that case your husband even though he's not the father is actually has rights if your married at the birth and he is responsible for said child. the paternal father will need a DNA test to even get rights and have to bring you to court. also the husband is same case still has rights because you were married. at least my state and many of them. I would definitely talk to a lawyer and look up exact laws in your state.

So make sure she knows that ahead of time. If he doesn't care then she's good to go if he wants the baby to have his last name and he acknowledged paternity and his name is on the BC then he can have it changed. All he has to do is go to office of vital records with or without her.
