So my bf and I got a new apartment and we move in Friday, buttttt they are going to file an eviction on Wednesday for the apartment I'm in now because I haven't paid the rent for this month (can't afford to pay 2 rents) .... How does an eviction work? I hate that they're going to do that..😢 will I be able to stay here til I can move in the other apartment Friday??? I'm n NC by the way. I'm trying not to stress over this.
Yea that's what my notice says. I can't pay the rent because we put our money to another apartment where I won't have roommates. We all pay seperate rent here. But since I'm having a baby and bf I don't want roommates. They said they're filing for an eviction on the 10th so my question is will they come evict me before the 12th which is when I'm gonna move out and into my new apartment @jsb87

Nonpayment of Rent
If the reason the landlord wants to evict the tenant is due to nonpayment of rent, the landlord must generally give the tenant a ten-day “notice to quit” before starting the eviction process. (N.C. Gen. Stat. § 42-3.) The purpose of this notice is to demand payment and it is therefore colloquially called a notice to “quit or pay.” If the tenant does not pay rent within the ten days, the landlord can proceed to file eviction papers on the 11th day.
Ok I only need until Friday, I just don't want them to change the locks on me and I lose my baby's stuff that's why it's bothering me. I'm going to see if I can look it up @tiffany09
You should look up your states eviction law but I thought everywhere they are suppose to give you 30 days to move out. Especially apt complexes and the eviction notice has to process first then be served to you or it isn't legal. I just went through this with a family member smh lol @babymercado

@babymercado, i believe that here in California they give you 3 days... So you would have to be out before Friday. I'm not sure the laws where you live, also after the 3rd day whatever is in the apartment is no longer yours. Sorry momma
Yeah they will give you some time to get your belongings and leave. Like a week or so
If they file the eviction on the 10th and it states on the paper you have ten days from that day, the 10th, to move out then you have the right to stay until the 10 days are up or whenever you plan to move which up state is only two days after they file it. They can't force you to leave if it's in those 10 days. Let the landlord know you have this information. And as well seek legal aid. I had to evict someone from my apartment because they trashed it and set furniture on fire but in my state they have 30 days to move out.
