My 7 yr olds father decided to get married and have 3 more kids, my sons support didnt go down.

They do not look at your spouses income, didnt with my cases.

And he isn't a dead beat dad either. She cheated on him when she they were dating and she was hardcore into coke. She even broke it off with him, then 3 weeks later found out she was pregnant. Of course she didn't tell my brother she cheated but she kept telling the other guy she thought it was his too. He wanted to be involved, asked to go to appointments, especially the gender scan... She said he could and then called him the morning of and said no. Then text him later that day to tell him it was a girl. When she had the baby, her dad came out of the delivery room and showed my brother pictures on a digital camera after he had been waiting for 7 hours, then told him she wasn't accepting visitors and to come back "some other time". She wouldn't even let him see the kid for the first month and he had to take her to court to get visitation, which consisted of him going over there 2x per week for 1 hour to see his daughter. Now, 4 years later, he has her everyother weekend and two nights per week (this has been happening since she was 1). He loves his daughter and does everything for her, but his ex treats him like crap! He is getting married next month and his ex actually told him that he had better get married on "his" weekend if he wanted his daughter present at his wedding because she refused to switch weekends!!

I know a lot of you have to deal with dead beat dads and I totally agree that they need to support their child. I just wish his ex knew how lucky she is to have a dad who is involved and loves his daughter more than anything.... Especially when there are so many men out there who don't even give a crap!!

My brother isn't trying to get out of paying support just because she is married now, he just cant afford to pay anymore than he already does. The $100 per month for daycare and half of medical bills that he pays her in addition to the $350 support was never demanded by courts, it was just something she asked him to do, so he said of course! So the courts don't even know he pays all that, they just think he pays her $350 flat.

I am not saying it doesn't take all that to raise a child I have a child so I know...and unless toy have a deadbeat as a baby father none of that should matter...my husband provides and does more than his child support does for his daughter and even though he pays of she call we do all that we can.

@jess there is a chance his child support could go down not while she is preggers but once she haves the child esp if that child lives with him

I think the end you should know who you are laying with...before you make a child my husband out himself on child support legally because years of just sending money orders and having her keep his daughter away was eating at him so he falut for custody and filed for himself..she would always throw up I'll put you on child support and make you pay more if you don't do this...well she gets less than what we were sending in the money orders

The only point I was trying to make about the comparison of being a SAHM vs unemployed, is that I am able to stay home bc I do have a spouse that wants to support myself & my son. My sons father simply doesn't want to work, but he's in no way financially secure. Rather than feeling it necessary to provide even basic necessities like food and shelter for even himself, he leeches off his parents and GF. GF let's him live with her, he pays no bills and contributes no money to the household even though she's broke with two kids of her own- and both his parents and gf give him gas money, cigarette money etc at age 32. That's irresponsible.

As for it costing nothing while he has him- I'm talking about the big picture. When you look at a residential parent vs non residential, there is significantly more cost involved for a residential parent. Look at housing costs for instance. Your mortgage or rent is generally going to be higher if you have to have an additional bedroom. Then you have groceries, transportation costs, clothing, education expenses etc. A nonresidential parent doesn't have to worry about those things of you only see your child every other weekend.

The point I tried to make in my previous post, however, is that I have never received support for my son. I've never needed it, and never made it an issue. The only reason i'm even receiving it now is because he thought he could get custody of our son, in hopes of getting money, which backfired. But I DO think its utter BS for EITHER parent to think its okay to not provide any type of support towards their child's upbringing. If he was married and had a spouse that supported him, great. But sadly this is not the case.

My ex also thought just cause he had a kid with this girl his support would go down and told the judge he can't afford $254 a month with a new baby on the way..ha!

It's not up to a new SO to support a child that's not his LEGALLY. That's letting the non custodial parent off Scott free. When I deal with paperwork for my son the only income is mine and my exes. The only time a spouse is included is that of the non custodial parent that gets married. My exes new gf HATES that he pays me support cause my new man makes damn good money. Mind you whatever my son needs my bf is there to help. Not my sons fault his dad is an idiot and his gf is only 19 and don't know ish. This may vary state by state. I'm in washington.

he is right that when the child is with him it cost you nothing and a court will uphold that...when we have my dh daughter for the summer he doesn't pay child support.because he has taking over sole responsibility for her care...but other than that he pays...and if you are unemployed by a licensed operation why the quotations you DON'T have a job and living off the support of your spouse...why would you expect them to not look at that?

They do license suspension for delinquent support here Ohio - but when I asked my attorney about it- he said basically you have to be really behind, usually 15-20k before they really do anything.

Which if he's not paid all that money for 7yrs I would think he's crazy behind!

7 years and you havnt got anything. normally after a few months of not paying the suspend your license then after that they will put you in jail. I would call your worker, they need to work harder at getting him to pay

I wish my bum ass father of my daughter would pay support. he never has. I got married last year and my husband provides everything including medical, clothes, food, tuition, field trips, etc. but her father has no problem commenting on things he doesn't like. uggghhhhhhhh really irritates me. he's ordered since birth to pay $419 a month. she's 7 now. smh. idk how I can get him to pay because he isn't working and doesn't keep a job....how do they enforce it if theres no income???

I jus went to court today for the first time regarding custody/support for my son, who's now 7. I've never gotten support from my sons father, all I'd ever asked him for was half of daycare when he was in that. We had a huge blow up in October and bc of his s*** ty life choices I stopped allowing him to see him for about 6 weeks. He's always been part of his life- but he sucks at being an adult. During this time his parents got him an attorney and he tried to file for custody of him. Hello, this is a man with a DV charge, prior substance abuse problems, mental health issues including a suicide attempt w/i the last year and hasn't had a job in over a year. It's laughable even now as I type this out.

Anyyyways, because I became a SAHM in November they look at me as being 'unemployed' just like him. Totally pisses me off. I'm not a deadbeat, I am just fortunate. Because of this they based my support on 'unemployed' guidelines and he's going to pay a whopping $150/mo. I don't really care about the money, and I never have, but it's purely a matter of principle. He actually had the audacity to tell me a while back 'it doesn't cost you anything when he's with me'

To put this in perspective though, my (male) friend was just ordered to pay $700 a month! He only makes around $1500.

Research and get a good attorney. Some states I believe DO look at a spouses income, which is what we were concerned about bc the courts don't want there to be a drastic difference in the standard of living between households for the child (I guess this only really pertains in a joint custody situation though?). I'm fairly certain my sons dad only filed for custody bc he thought he would get us to pay child support to him.

Lillas said it all. They cannot hold anyone but the biological parents financially responsible for the child. I went through this with my ex trying to get his support reduced when I got married. The judge laughed at him. :-)

I dunno. I think its fair that the biological fathers have to pay support unaffected by the mothers spouses income. He made the child, he can help support it. Why should the stepfather pick up the tab?

My mom got remarried when she was still getting child support. Nothing changed, until we were too old to get it of course. Marriage doesn't affect it.

My brother (who rents my basement) got a petition in the mail to pay more support to his daughters mother. He already pays $350 per month in support, splits daycare costs (which is $100 per month) and pays for half of any medical bills... So on average about $500 per month he pays total. His daughters mother recently got married to someone who is loaded... I really have no idea why she would want or need more support! He can barely make it as it is! He only makes $35K per year and works 6 days per week. The mom waits tables twice a week! Sometimes the system just isn't fair!

it shouldn't change, I'm not married but my child support hasn't changed at all, they never ask for df's information. ex is pissed however that they take half of his checks when he is only one person working and me n df both work n have good jobs!
