@greysonsmommy090316 good luck! If you guys aren't getting along I would suggest having your adoption attorney do it for you. That's what I did lol. My ex and I had nothing to talk about he knew what I wanted and just needed to sign or step up.

They generally can not. Most states have a law that requires someone else to adopt like your husband.

But how does that work? If my husband wanted to adopt my kids but they have my exes last name and on the birth certificate

Do you have contact with your ex? Would he be willing to allow him to adopt them? You could always petition the courts or obtain a lawyer to assist. If it’s uncontested it will definitely be a lot easier and faster. @massgirl, she may be able to answer better for you
