If your child’s dad is tryna take you to court for joint custody will the judge approve that even if you can prove their doing marijuana on a regular basis & has guns?

Most judges won’t give the dad 50/50 with the kids being that young. He is definitely not getting 50/50 if he is trying to move further than a different county where the baby lives, let alone 8hrs. It is a very big deal to do any type of illegal drugs. You can request him to get drug tested by a hair follicle vs just peeing in a cup or blood test. If he has any felonies he can’t have guns. But if he has a clean background, not much you can do about it. Make sure you save all evidence of everything. Don’t agree to anything you don’t feel completely comfortable with.

@alejandra1x, okay thanks!! He’s basically mad bc I don’t wanna move away with him.. but I told him I have to think of what’s in the best interest for my children.
@april.renae01, probably to collect assistance to be honest. Text him about the issues and tell him you are concern about his parenting and bring up all the issues with the weed and gun. But make sure you sound like concerned parent and not have emotions shown in that text. Print it out and use that.

@alejandra1x, well on top of all of that he quit his job & barely even have money in his pocket. He was damn near asking me for help every week.. he hasn’t really bought the baby anything. He sits on social media smoking weed & drinking all day, everyday. He doesn’t know the first thing about parenting which he has admitted to me himself. He is not stable enough to provide or care for a child on his own which is why I don’t understand why he wants to take me to court. He doesn’t even have a drivers license.
@april.renae01, he’s being petty let him take you to court he’s probably only using it as a scare tactic. It’s pathetic, collect what you need. Sorry if my responses seem to flip flop I response to the comments I currently see lol.
@april.renae01 I understand people deserving to be parents but both of those things are not safe around either child! So he either stops the weed and secures his guns or the children shouldn't be in his home without you. Just my opinion.
@april.renae01 by what you said his recreational use IS a problem and so is his gun stuff. Screenshot his Facebook posts about killing people and flashing the guns and take that with you too!!
@april.renae01, i thought it was for the older one. That process will take time and still people change for their kids he still deserves a chance to be a dad. You two will just have to set up a routine that works out best for both of you.

@alejandra1x, it’s not the point that he’s a bad parent. He wants to take me to court bc I won’t let him take my newborn baby 8 hrs away bc he is deciding to move a month after she’s born.

Then he have the guns all on social media flashing them talking bout how he’ll kill people & blah blah blah.. 🙄
& yes he smokes likes 10 times a day til the point he passes out & yea he leaves the guns loaded and laying around anywhere
@alejandra1x, no it’s for my newborn. Bc he is moving 8 hrs away & I told him I don’t want my child traveling back & forth while she’s that small..
@alejandra1x weed is still illegal in some states, including Mississippi, so it is considered bad.
How does you child feel about this. At nine she has a voice that should be heard, this is in her best interest. Does she say she doesn’t want her dad in her life?
Take all the proof of any kind of behavior that isn't conducive to child rearing with you. Having guns won't be something they care about unless he has guns he keeps out, potentially loaded, not secure...then they could see it as an issue. Otherwise everyone has a right to carry even parents.
Doing weed recreationally and not around the kids isn’t all bad, if he has a license to carry and is being safe having the guns stored properly there is really no reason to not let him have custody. Is he really that bad of a father that he doesn’t deserve a chance to parent??
Oh I do.. he makes posts on social media with it & smoking it all the time
