Probably said that because you would need to be divorced and have all the paperwork that makes sure your ex isn’t on the hook for any children born during the marriage that aren’t his. If your divorce paperwork doesn’t address the issue you have to go back to court and have it taken care of so that a judge declares that your ex has no rights or responsibilities towards your children that he acknowledges that the children aren’t his once you have that you can change the birth certificate

Go down to vital records find out what they need to make the amendment. Since you were legally married your husband at the time was automatically assumed the legal father. You’re lucky it says what it does and not your exes name
