Where this happened it is illegal to rude your bike on the sidewalk. Bicycles must follow the same rules as cars/motorcycles. The road was not well lit and the driver didn't see them. She wasn't charged due to circumstances. It was a tragic accident. I highly doubt she will win the lawsuit. I also highly doubt the parents will win theirs. In Canada we have million dollar car insurance policies and Universal Health Care so any treatment she requires for PTSD would be covered by one or both of those. She is being ridiculous.

Did anyone read that the other brother killed himself 6 months later. So they lost both of their sons and now are being sued for over a million dollars! Ridiculous!

I would personally be traumatized if I killed a child, but I cant imagine there being any justification for suing the family....id just deal with the "pain and suffering" in my big girl panties, no need to add insult to injury

I don't think any teen knows bicycle laws..I'm 21 and in texas and I didn't know about the sidewalk thing..but still in texas the driver is USUALLY at fault for hitting a cyclist or a pedestrian. That whole stupid "you should be paying more attention to your surroundings" at the end of the day the child's life is lost and that's just horrible. :( they should bicycle education or something other than the common stuff, wear a helmet and pads, pay attention to cars, and I think it's either cyclist have to ride on the opposite sides of on coming traffic..

The boy is dead and she wants the famliy to pay for her greif is insane.. I dont care if he was riding his bike wher he wasnt meant to the fact that hes dead and to top it off she also injured his friends.. It be really sad if she did win her case i mean where had humanity gone in this world..

I would not think to sue anyone, even if it was the kid's fault. I'd feel extremely awful that I took someone's life.

Where I'm from(Texas) bicycles must follow the same laws as motor vehicles including speed limit and stopping at lights so that means no riding on sidewalk. Anyone know bicycle laws where this happened?

@PP Idk about where you live but where I live you can't ride your bike on the sidewalk. There are signs everywhere that say no bikes on the sidewalk.

Hope parents counter sue for their emotional distraught and medical bills and funeral costs and burial costs. Court costs and the emotional pain of the proceedings. Sure that comes to equal or more.

The only reason she's allowed to do this is because the 17 year old was technically found at fault. He was riding in the street with no helmet, no reflectors. However, she's definitely going to lose because it is absolutely insane. I can't believe a lawyer would take on this case.

I hope she not only loses but has to pay their court costs.
