Caught shoplifting
Dh's cousins 18 & 16 got caught at Sephora stealing $130 worth of merchandise. They both gave a wrong last name and then called their cousin saying it was their mom. When she showed up she told the police that she was the cousin and not the mom. They are both to go to court at the end of the month. What should they expect? Do you think the 18 year old will be put in jail? I'm so disappointed and mad at them. The 18 year old graduates this Thursday and the 16 year old is/was going to go to Europe for her junior year of high school.
If its their first offense, they won't go to jail. They'll either be put on probation or diversion, have to pay court fees, possibly do a class and/community service and probably be banned from the mall/store for at least a year (I've never gotten in trouble haha, but two of my siblings have done similar). They better learn their lesson this time though or they'll definitely be in worse trouble next time.
My sister got charged with grand theft. (over a 1000)
She was given (jail time served as she didn't bail out) probation for 5 years, until she kept effing up. And then received 5 years prison and on parole to either be a total of 14 years or the parole board agrees to early release.
These are petty theft. Doubt it'll be bad for 1st time offences,
The 18 year old should be put in jail for a bit. At 18 you damn well kow better than to shoplift. And the traveling should be cancelled too if the parents happen to be funding it. That's ridiculous for an 18 and 16 year old to think that's ok, and then to try to lie to get out of it. Consequences need to happen.
This is so bad but all I could think 130$ at sephora was probably only like 2-3 items. But in all seriousness the 18 year old should be very worried. Hopefully this is a first offense and can get community service especially if they have been accepted to college and can show the judge this isn't the path they want to go down..
If this were my case and the officer didn't charge her with false ID, then I would ask for a finding under advisement for one year. If she's of good behavior and doesn't get any new charges, it will be dismissed. It'll show up on her record as a dismissal though. That's not something she can get expunged in my state, but it shouldn't hurt her down the road since it's a dismissal and not a conviction. Same for the juvenile but it won't show up on her record at all.
It's a slap on the wrist but with teeth because if she steals again she gets convicted of this one and potentially the next. The third larceny is a felony.
If the 18 y/o was charged with false ID, I'd move to get rid of that charge and all suspended time on the larceny with 20 hours community service.
They will prob get a fine and possibly community service. I highly doubt they would put anyone in jail. If I'm correct I believe it's just a misdemeanor since it's under 500. Stealing is stealing whether that be $5 in merchandise Or $100. Just because it was only 2-3 items dose not make this situation any better. Those returns Pp is talking about come receipts and proof of purchase. Those pepole Actully paid for there product. Hopefully this will be a wake up call. The 16 year old will have it off there record by 18 but the 18 year old is a adult and will now have petty theft on her record.
Shoplifting, then giving wrong names and calling someone besides a parent to impersonate?
They both need a life lesson. If it ruins their plans, so be it.
As for the comment about it 'only' being 2 or 3 things, it's still a lot of money. If they were my kids I would be thanking them for pressing charges.
Stealing is stealing and it can be something they repeat throughout their lifetime, if not caught and suffering serious consequences.
First offense with a misdemeanor - most likely 3-year probation and community service plus a fine. The 18 year old is lucky they didn't go to jail that day..both of them actually.
