Does anyone have any legal knowledge regarding expired tenancies? If you do can you message me please. Just want some advice and would rather not post it on Facebook. Tia

Hiya, i am a landlord. Have a look in your contract to see if it says your contract continues to role after expiry. If thats the case Unfortunately you’ll have to give a months notice and pay for that last month. However you can leave whenever u like. Just means you’ll be paying for a couple of weeks you wont be there. X

In mine i always put that the contract will continue to role and that i must give 2 months and the tenant must give 1 month if they wish to leave. If it doesnt state anything and you havent signed a new contract. Tell him ur leaving and that ur moving into new premises by 5th june. X

@pearce5443 i think your right about just talking to him, no working smoke alarms is against the law, and mould is extremley bad for your health, good on you trying to be decent but i would make a fresh start a lot of people would not have paid full rent or any at all with those issues so think youve been decent enough. If its a shorthold he could say its rolling and some of them mean 2 months notice, but again their is no deposit to loose so he really couldn't say you have to do that. @rachaellw Yeah I know I just don't want to mug him off because I'm not like that. I'm just going to talk to him and hopefully he will be ok about it. Considering the tenancy has actually expired xx

@annie.entwistle I really don't want to screw him over. I might just explain the situation to him and see what he says. That way I've left the ball in his court. If he says 1 months notice that's the way it will have to be. I've been here for four years. Never missed a rent payment etc. I just feel he hasn't extended me the same courtesy as a landlord I've told him for the past two years the two of the windows in the flat are broken (not smashed just drop when they're opened). He has never addressed the fact there are no working fire alarms or that there is mould (it's not horrendous damp just a little). But I know you're right. I should be a decent person and give him the notice stated when I moved in 😔. Makes me sad I'm going to have to fork out money I could do without having to spend if that makes sense. Xx

I would maybe speak to your landlord and see what they say. I’m really not sure where you stand with it hun, it’s kinda his own fault for not keeping up some kind of contract with you. X

@pearce5443 i work in housing, if you have no deposit or tenancy agreement you really have nothing to loose, if you want to be a decent person i would give 1 months notice. If you had a deposit it place it would be a different story. Let me know if i can help xx

@rachaellw I didn't pay a deposit. And it's a short hold tenancy from what I've read it isn't a rolling contract. I definitely want to give as much notice as possible as I really don't like to annoy people but I can't miss an opportunity on the new place if that makes sense.....I'm so confused with all this. It's just stressing me out xx

Are you sure it’s not a rolling contract as such? I would try and give as much notice as possible as you will want your deposit ect back. X
