This depends largely on your state laws etc. I'm only familiar with Florida. But for peace of mind u should be able to consult an attorney and sometimes the consult is free.

The judge won't even fight you over it , well I live in va and The judge never takes the child away from the mother unless she has charges or she's abused the child

it sounds like a strong case! does he do drugs? if so see if the lawyer will have the judge make him take a pee test

@patti28 I've got a lawyer but so does he. Right now he's trying to get visitation so he has a home visit scheduled. I put in for supervised visits but the prob is he's trying to have his dad be the supervisor and his dad can't even supervise himself, he's that fucked up most of the time

My husband's mom was the same way with prescription pills. They would not let her be his supervisor when we were having problems but she had a document history. Does he have a history with it too?

Do you mean is he actually prescribed the shit? He is but he takes WAY too many. I'm talking he will go through 180 of these things in like a weeks time. He has also been on suboxone which is notoriously used for drug abusers. This man goes to the hospital about 4 times a week complaining of different ailments so he can get morphine. One look into his med records and it'll be obvious @christamoore2012

That's what I meant is it documented that he is an abuser with the courts? That's how I won against my mother in law. But if his can be proven with hospital records then I don't think he will be allowed. My case was also in Indiana.

you could probably get a restraining order on him for threatening you if you have proof. that's what I did when my husband sent text messages to my family saying was going to get revenge. just get ready to spend a lot of time in court

Yes...it's easy, just make sure you save texts and document each incident. You might wanna look into getting a restraining order on him! That'll help your case out too!

@goodbyelullabye yeah I saved the texts and the officer wrote them down word for word. We're supposed to have mediation in December but I don't even want to mediate now because of this shit! He said he was gonna come shoot me dead and he actually has a gun so I wouldn't put it past his crazy ass, and when I told him ok well if you're gonna threaten me or my family I'm just gonna call the cops and he said "good call them and tell them there's about to be bodies droppin". I think he was just being stupid and possibly drunk but even so you don't say that shit!

Why would you invite him to your house after pressing charges for him threatening to shoot you just yesterday?! I'm sure you don't have anything to worry about custody wise with everything that's gone on its clear who the unfit parent is. Talk to your lawyer & let them handle it

I didn't invite him, he said he was gonna come see Oakley & I don't want him to use it against me if I don't let him. But I kind of knew he wouldn't even show and he sure didn't so there's that. @mrssanderson
