No the father of the baby is the father of the baby. If you don't put the biological father on the birth certificate then LEGALLY yes your husband will be legally considered the father by a legal stand point (which can be changed by a DNA test) if you put the babies actual father on the birth certificate then he has his legal parental rights, from day one and your husband has no legal rights to said child

@thehowtohippie sadly Texas does goes by your maragie status and not DNA until DNA is proved. Even with Joe on Brinleys Birth certificate until we either get married or we go to court I am considered the only one with parental rights when i get unhitched

in Alabama though yes it's if you are married yet separated but not divorced, your 'legal husband' is who goes on the birth certificate. I went through the same thing with my mother and her ex husband and my father. something about a 'no bastardization law' or something like that. complete BS. if you are currently separated from your 'spouse' I whole heartedly hope you are able to file for divorce. he will have parental rights once baby is born if not. it sucks. if you aren't able to file just yet, have your fiance adopt your baby. court has to do a DNA test at that point and when it proves to be your fiances child things will be set straight. that's what my mother had to do with me.

Try going to the court house and seeing if you can put an add in the paper like stating you want a divorce blah blah it has to run for 60days and then a judge will sign off on the divorce papers .. your ex husband doesn't have to be involved at all. my ex husband went a wal with his fat wife now and i had to do a add in the paper.
