So I have a question for the moms that receive child support. My sister was married to her ex husband for 7years and 3 kids later, well they been separated for over a year now and her divorce was finalized a few months ago. He has a new gf now who is about to give birth to his baby come March. He took my sister to court for child support cause she didn't want it from him but he insisted he'd pay. Well she just started getting it a little over 2months ago. She gets it every other Tuesday but last week he told her she wasn't getting the full amount cause he had missed work for a week and his check was low. I thought once it all goes thru court and he's supposed to pay a certain amount it stays like that that he can't choose to pay what ever he wants when his check is low. And she was supposed to get it this Tuesday and nothing she called the place and said it wasn't taken out. She tried calling him at work and his cell and no answer. Basically he just wants to pay when he wants to. Since its court order and he's not doing what he's supposed to can she take him to court and get his rights taken away? She rather not have to deal with him at all

He had put her and the kids thru a lot to cheating on her so many times got someone pregnant before (she lost the baby) and forgave him and just three years ago the day after Christmas he left her and the kids and that wasn't his first time. He left her to raise three kids on her own while he jumped right in before their divorce was final and made a baby with someone else. He never done anything for the kids since he been gone almost 2years. The past two years I had got my nieces their school uniform and school supplies cause he couldn't man up and didn't care. And his family treated my oldest niece differently cause she wasn't blood related. He's not around now and hasn't been the past two years only came to see them twice within them two years and only calls when he feels like it so I don't blame her for not wanting anything to do with him. She been doing it with out him and he only wanted to pay child support just to have that attachment to her
Honestly if he actually wanted to pay for a child that wasn't even his including his own, I think it's a pretty dick move to want his rights taken away. Like, she didn't even want child support to begin with and now she's being petty?
if he put down 3-20 dollar the child support agency won't care because he's paying something now if he's paying nothing then that should be a issue to them
@lucasmomma, yea hers is taken out automatically so when he said she wasn't getting the full amount this week idk how's that possible cause I thought once the paper was all filed for that and been got started it'll stay that way and no one can change it when they want unless it's by the judge

He makes over 1200 a pay check and she gets 250 or 275 from him but he told her she was only getting 1something cause he missed the week cause his gf was in the hospital. But my oldest niece isn't biologically his, my sister was pregnant with her when they met but he wants to pay child support for her so it's supposed to go up to 3something but it hasn't and it's been 2months now. He's real cool with his boss so I could see him telling his boss to do that favor for him cause he's ignorant like that @meganbrewermommy3
visitation/rights is separate than child support. once he gets so far behind she can take him back to court.
im not sure if its depends on the state but he can go to jail for not paying. my hubby pays child support for his daughter and his is court ordered and is automatically taken from his check and if he doesnt pay he will have back pay like when he was first ordered to pay. but she can take him to court for it
it's a day behind. She should have got it Wednesday. Monday was a holiday
the regular amount will come out as long as he made enough.
