random question, just to be on the safe side of things I want to do all my research....if my son is given his dads last name who I am CURRENTLY with does he have more rights than me ? if I was to take my child away from him could he call the cops ? may be a silly question but I need answers 😩

Most states its 50/50 we went through this with my husband's ex they never went to court so if we take the kids and don't bring them back she can't do anything but call a lawyer and get a court date to get them back and same with her the only way to be sure is going to court and you both will have to be there

kinda depends on what state your in I know here in texas even if dad signs the birth certificate and baby gets dad's last name if mom and dad aren't married he has no legal rights unless he files for legal right of the kid which would put him on child support

my daughter has my ex's last name and the only way he took her legally was by filing a protection order against me. I now have full custody of her and he has to pay child support and only has supervised visitation. I highly recommend either not putting his name on that way he has to take a paternity test and go through court to have any say with the baby. You may be the mother but its always he said she said.

I've been told the mother has more rights especially if your not married to the guy

In AR it dosent mater if the dad is on the birth certificate, if your not married he has no legal rights until there is a court order.

usually getting full custody involves both parents going to court, unless one parent signs over their rights. but just tell him if he runs off with your baby you will call the cops and report it as a kidnapping, that is completely legit.

Your child can have neither of your last name...it only matters who is on the certificate. You have to prove something to keep one parent from the child...

But if either parent just runs off with the child, they can call the cops and say it's kidnapping. you need to get custody.

no he has 50/50 rights just like you. if you leave and take the baby he can't call the cops and vice versa cause he of on the birth certificate and y'all haven't went to court neither can get in trouble

without a custody agreement from a court both parents have equal rights to the child.

they will normally never take a child from his or her mother unless they have a reason. mothers I believe have more rights then fathers.

No. And if he were to take your child you can't call the cops either. They will say it's not kidnapping since he's on the birth certificate

Question. I just left my husband for cheating and now hes been harassing me. Hes threatening to come get our son. I dont care if he sees his son but I'm not comfortable with him leaving with him bc hes never taken care of him a day In his life and he might use him against me. Am I wrong for feeling this way??
