So as far as FMLA yes you have to be employed for a year but however if you go out on maternity leave you will still have your job and that's what the law states if I remember correctly we have been protected by that law for more than 40years now. I had this same talk with my manager when she found out I was pregnant

That's true. You have to be employed for a year to qualify for FML.

but I don't want to have to find a new job I want to keep this one I loved it when I shadowed and the manger seems very nice... just when I went to accept and told hr I am pregnant she told me that I can lose my job once my PTO is up since I won't be meployeed for an entire year.... even though I worked for the company for four years and left in march due to my nice passing away and my children needing me and being in nursing school was to much

You'll be fine they're alway hiring for RN in Pa. I don't think you'll have a problem find a new job it's such a high demanding job. At the hospital I work at they have like 20 opening now for RN at my job

It also depends from state to state. And most company's go by how long you have worked there.

I did HR is the people that said this to me as they called to offer the job and I said yes of course as I really wanted the job. when I told her I was pregnant she told me that just so I am aware that once I go on maternity leave and all my PTO is used up they do not have to keep my job

Yes and it also depends on your job duties... The 6 weeks of maternity leave is mostly for bonding purposes.. You can go back to work as soon as a week after labor.

that is the most ridiculous thing I've ever heard. :| I'm very sorry for you if this is true....
I've actually been turned down for positions because I'm pregnant. I've been told I'm not worth the time to train.
I would speak to the HR department and maybe contact the department of labor to find out more.

it isn't union she said that pretty much whatever PTO I acquire while working is the time I will have and if its up before doctor clears me then I will lose the position and have thirty days from that point for the manager to reinstate me as long as she thinks I was a good team worker

If you are apart of a union they should protect your job.. I work at a hospital that's how it is for me when I deliver in June... If not you can get a doctors note for 6 weeks of maternity leave and you should be able to be out with that otherwise you will have to return to work as soon as possible after delivery to protect your job

it covers once you've worked there for a certain amount of time. but you could still get leave just like everyone else. just call HR and ask them and then ask your manager/head for the request of absence leave papers and have your doctor fill them out, and you could get up to 12 weeks if you ask your doctor.

You can't get FMLA in PA until you've been employed by the place for at least a year.. Are you a union worker at your job?
