If she is claiming head of household and you both live there and do not work then yes she can claim you and your child as depents

oh im sorry you gotta go through this :-/ now i read your whole comment just now:)... the last part about changing her last name eekk idk if thats a good idea, im not sure where you live but i know in texas the attorney general makes us change the childs last name to the dads last name if you tend to put him on child support... he said he does that because he gets so many kids when they get older wanting to change their last name. i had my daughters last name as mine up untill she was almost 2 and they made me change it when i filed for CS :( ... I would look into that.

@firefly, i dont think he could either he has some charges that im sure would make it impossible but the thought of it still scares me. im going to go talk to a lawyer and see what my options are. @mommybump3 apparently to them they think that she has the right and no i didnt. i was going to get a job then i found out i was pregnant and he wouldnt let me get one... @brittanymetzger7988 it just makes me so upset that they would do that. @seleneromanortiz12 to him and his family i guess i have no say he makes all the decisions when it comes to anything and when i say anything he just says well its not up to you! @rachel8792 she doesnt pay for anything for my child. im not a bad mom or an unfit mother but the thought of him trying and winning just scares me so bad.

they can get in huge trouble if they do it without your permission. if they do, report it and they'll have to show you signed something and if you didn't, they are shit out of luck.

@juliagail09, unless she truly pays for more than 50% of the baby which i doubt she does, cuz thats what im sure she has her son doing i would report her, then they can look into all her taxes and audit her... im sorry girl but i would be pissed

uhm just because she has the same last name does not give her right to claim your child..did you have a job last year? & dont worry about him taking her away from you. a judge will not grant the father custody of a child unlesd the mother is a drug addict and cant take care of a child. . you have no worry there momma!

Girl he can't take her away do you know how hard and how much money in court cost it would take. Leave that house take that baby and go to your moms! Go down to the court house and file for primary residence and child support
