Okay I’ve read all your other posts about your ex and I have a Few questions. Is he paying child support? Other than the medical paperwork is he responsible for keeping the insurance? I’m assuming you can get them Medicaid, as someone who now has Medicaid for her kids there really isn’t a need to have a secondary insurance since Medicaid will cover the cost....does Medicaid suck 8 times out of 10 yes it does! But it’s better than having to jump through hoops to get him to be responsible for getting insurance. I would suggest going to court and getting it in writing who is responsible for paying for her insurance and if he doesn’t have a job that can pay for it how the private (Obama care) insurance can be purchased and whose responsible for it.

I worked for an attorney and I can tell you if the custody order does not say anything about a passport he does not have to sign any kind of documents for you. If it isn’t stated in the order about traveling or restrictions he does not have to sign documents for you because he can claim you’re trying to kidnap your daughter or take her against custody orders. It’s a very nasty gray area which is why I would honestly recommend going to court and making sure this all gets added into your custody order. The reason I asked about child support is because the income credit and stimulus are for the person who is paying for the child (to help with expenses you may inquire caring for said child) so if he is current on child support there really isn’t an obligation for him to give you ANY of that money. I would look into adding a stipulation in your agreement about alternating years, meaning you claim her one year and he claims her the next. Most of the cases we worked the attorney would make sure the dad (we mainly represented dads) always had claim for the child since they where the ones being financially responsible the child. If we happened to represent moms we would fight for the alternating claim years but if they didn’t work the judge almost never gave them the ability to claim the kids on the taxes since dad was paying an arm and a leg in child support.

And I’m sorry if I sound rude or anything along those lines I just want to make sure I give you some insight into what I would see but I’m in California so everything I said could mean absolutely nothing in New York. Good luck. Take him to court and get everything you have questions on cleared up. If you have an attorney call them and they can advise you on what your next step would be. Im sure you’ll have mediation before court so if he’ll play ball you should be able to settle this all in mediation.
