A quick question please help me: my youngest daughter is on my ex husband's income tax because the court ordered it but she is living with me as you know. is he suppose to give her income credit to me? Or keep it to himself?

@no062014 it's says and I clearly remember the judge saying that in a stern voice to him "whatever paperworks that she provides you you MUST sign.... And she can't work due to her physical disability you have to pay and keep her updated on the girls medical insurance..." (Which he isn't, I get bills and forward to him, it's been 3 times in a freaking year that he changed it, and living in nyc without medicaid and a secondary insurance is impossible) it's too hard for me not to worry... Plus I have blood clots in my brain from my childhood so that worsen me up

@iqrahp5 Def time to go back to court. Passports fall under different category. Been through this for 7 years with my nephew.

Guys thank you for your help with this.... Both of the kids are in my care... Due to child support I file and give the money to the irs yeah give them back not keep it because of not able to work due to me having a medical condition called encephalitis

Are both kids from the same dad? That’s usually the only way a court would let him claim her if she didn’t live with him. I wouldn’t fight with him over it, if you think it’s unfair then try to modify the custody agreement in court. He’s legally allowed to keep it for himself since it’s court ordered. Since they made that type of order, I’m sure he’s paying child support for both kids as well so it’s kind of a wash.

Ok...I see you have 2 kids, I didn't notice that before. I'd imagine the judge has told you to each claim one child. That's pretty normal. You just take your check, let him have his and move on with your life. NOT worth fightin over a few hundred bucks. It's not like we're talkin bout $100,000 jackpot or somethin. In the grand scheme of things, it's not that serious and I'd just let it go.

Morally, he SHOULD give it to you, since she's in your care the majority of the time. Legally though, the credit is paid out to qualifying "dependents", based off one of 2 year's tax returns, (depending where your filing date fell) and she would be listed as HIS dependent and the check legally, not RIGHTFULLY, but legally is his. Sorry Mama. 😔
If the custody and/or living arrangements have changed since the order was put in place, I HIGHLY recommend you requesting a court date for a review of your situation.

I need to clear this... I am NOT after the money because he is on child support the court gets him to pay but after 3 months and I know that he is getting paid under the table but that's a different story

Yesterday I went out with my boyfriend went to watch a movie, me and him don't live together yet. but point is yesterday when he was dropping me off his like sleep over at my house witch the mom and dad lives. I said no, his response was why is everyone deciding or making choices for you and their going to do the same with the baby, when I know that's not true. what he thinks is that my mom tells me not to sleep over. So he left all mad. and I felt in my heart that he went on and cheated on me and did something else with an other girl.... and it's 10:51 am now and he hasn't texted me at all. and after he dropped me off I texted him saying what I felt and nothing. I don't know if I'm over reacting or what or what should i do. do i wait until he text me?

I need some advice. My boyfriends wants to claim me on income tax but when we fight he tells me to leave and all this shit so I don't want him to claim me I want to do my own but he keeps nagging me about it. What do y'all think ? I don't want him to claim me then turn around and try to fuck me.

And another question is that he isn't signing the papers that I need to apply for my oldest daughter's passport.... In the stipulation of the court he has to sign paperworks that I provide to him for the kids.... He got it notorized only... No signature or photocopy of the photo id.. what to do with?
