Hi guys does anyone have any idea on this topic...my father in law passed away recently and my mother in law has a council property. My father in law was 88 and has been living in the property for 32 years with my mother in law. My father in law is the main tenant and was getting the housing benefit. Can the housing benefit be transferred over to my mother in law? Also, is there a chance my mother in law May be evicted as she isn’t the main tenant but is legally married to him!! Xx

If she isn’t a named tenant then the council will kick her out. That happened to my fiancé’s friend 😢 xx

Her name and 2 of her kids names are on the tenancy agreement. Does that mean she can get it transferred ?

Think she has to have a joint tenancy otherwise she will be evicted. My partners nan passed away a few years ago and his uncle (her son) lived with her and he had to put his name down for a 1 bed flat (they were in a 3 bed house) and then they evicted him as they wouldn't transfer the tenancy x

From this I think she can get it transferred to her if she has proof of how long shes lived there etc x

In Nottingham, if your not named on the tenancy, you loose the house. It happened a few years back to a man I knew. His partner did a runner and him and his 4 children lost the house and had to go into a homeless shelter because he wasnt on the tenancy. I think every council is different and has different policys. The man I knew might have lost the house because his partner didnt die, just ran away. Best of trying to ring first thing tomorrow morning, hope this get sorted quickly for your mil xx

yes I'd say so, as long as her name is on the tenancy. Like I said i think all councils work differently so I might be talking out my a** about it hun x

I got the house and wasn’t even on the tenancy at all. Just had to show 12 months worth of proof of address x

I’d say so. It might be different for different housing associations but with mine you just show the proof that you’ve lived there for 12 months x
