I don't think so unless there has been a court order from cps that says other wise
Can you call the social worker that cps assigned and asked. I would tread carefully in this situation.

@massgirl, many people have told him that he should do what he feels is right, and seems to be leaning towards keeping her. She came back with a huge bruise on her face, like the length of her cheek.

so if he plans to keep her he needs to take away the mothers custody. He can't just ignore the current court order. He needs to file a motion to modify the custody agreement based on abuse. I hope he took pictures of the bruise and called the police on the ex.

Yes. if there is a custody order it must be followed unless stated otherwise. Listening to others could get him in deep shit.

Then he can keep her but must asap like now call cps . And or the police . Then go file in the morning to have this custody agreement changed .due to abuse .
