Maybe I’m blind but does anyone see in section 12 that it says during observation an admin must be present with the parent during the observation?? It says the principal must give permission.

he is in first grade. The issues started in pre k. I was told I had to wait until kindergarten to request a 504/IEP. The principal during the meeting said he qualified for the 504 based on his mental health diagnosis but not an IEP. My sons case manager told me it’s not up to the principal and that we can do the request for an IEP because it’s up to a panel not her. So we submitted the letter and now it’s in the process of review. His 504 is for basically there to help him in situations that trigger him/sometimes no trigger is needed when he becomes angry, aggressive, emotional out of control. He has a very hard time regulating his emotions, anger and aggression. He also hears voices. My son goes 0-1000000. He can hurt himself and/or others. He is disruptive. Last year when the 504 was in place he has he adhd diagnosis and in February of 2019 he was given the bipolar 1 diagnosis and right now he is on a wait list to have further testing because his therapist thinks there’s more going on. I have him in intensive in home therapy 2 times a week, he has a case manager, he has outpatient therapy and he has a psychiatrist that prescribes his medicine.

@dontblockmesis-imjustspeakingfacts, I’m glad you put in a written request for an IEP meeting. She was out of line to say he didn’t qualify. That is a team decision and, as the parent, you are part of that team decision. With the bipolar diagnosis it would be a bit easier to get the IEP. Even then it’s not a guarantee, but with your description of your son’s behaviors I can’t imagine it’d be difficult to qualify under the ED category. Likely that would mean a change in placement to a more structured classroom setting but that completely depends on the child. I’m surprised she’s refusing a review of the 504 with the new diagnosis though. When did you put in your request for the IEP meeting? I believe the law says the meeting needs to be scheduled within 60 days. Hang in there. The road to getting an IEP is a long one and it can feel like a long wait, but in the end it will be worth it.
