I have been thinking a lot about my 10 year old son and what if anything had happened to me, leagally what would happen to my son? Where would he go? But in all reality if anything happened to me tomorrow, my son would go to his biological father who he doesn't know at all and never been around really. And I dont want that to happen. If anything at this point and time if anything where to happen to me, I'd want my son's guardian to be my mom. She has good ethics, good morals, patience, church goer, great beliefs, and is stable. How do I go about getting my mom guardianship if something ever happened to me?? My mom said she'd be a guardian to him when we talked about it when my son was first born but time slipped away. And right now it just seems very important and I have been thinking about it alot

Does your ex have any contact with your son? Does he pay child support or have any custody agreement in place? You should probably book a consultation with a lawyer who specializes in wills. You can establish guardianship in a will.

He doesn't have contact with him and he does pay child support on occasion.

His father will get him until he signs over his rights. Unless he didn’t want him then he can go to your mom. But he is the father so he will be next in line.

Even if I have full sole custody from the court and make a will stating I want my m, his grandma to be guardian?? And he's never been in my son's life

That seems a little weird to me plus seems uprooting a child to another state, life, family and stranger. Doesn't seem right to me

I mean you mY have sole custody, but he is the father. He has rights. He has more rights than your mother does (legally). If the parent who has custody were up die, that other parent still has responsibilities to take care of the child. Your son is his father’s responsibility.
Ask him to resign over his rights, that will drop all responsibilities and your son can go to whoever you choose. Other than that the state first call about your son will be his dad.
