I need some advice. I work in a school, I returned from maternity in September and specifically said I didn't want a certain class as they were well known for being hard, under performing, lots of behaviour and special needs which the school just isn't equipped to deal with, I said it would affect my existing anxiety as I've never worked and been a mom and would like the easiest transition possible. Obviously I got that class. Well now, because I can't perform miracles and they have no sympathy for the fact I'm trying to balance all this they have said if the class does not improve in the next 4 week's I will be let go with "incapable" put on my permanent record and future references. I hate it there, it's massively impacting every bit of my life, I spend all weekend working away from my family, I don't see my OH

Wow! That sounds awful and like a pretty awful school! Is there no way you can leave and work at another school??

It depends if I can find something suitable before the 4 weeks are up, regardless of whether they decide to get rid of me I don't want to work somewhere like that. It's also difficult because the point should be to find somewhere that makes my life easier and obviously most school jobs are 5 days which is tricky with LOs nursery

Sounds like constructive dismissal to me, seek legal advice. Do you have anything in writing to back up your request to not have that class? Sounds like they are leaving you no option but to quit and have deliberately set you up to fail.

I have contacted my union but due to workload I am not hearing from them. Super. It is exactly constructive dismissal but they can't play it that way because that would mean I could get redundancy or a pay out which due to school funding they can't afford so it's easier to do this which potentially affects all my future jobs.

Unless you are in a probationary period you cannot be let go for being incapable of the job without warnings being given and also relevant training being provided. But also you cannot pick and choose your class, someone has to teach them 🤷🏻‍♀️ all female teachers I know have left teaching after having children because it's too much work when they would rather do something with less responsibility and have more time with their kids.

No I know but we are allowed to give 2 preferences for which class we'd like with our reasons so that's why I made the above comment.
