Okay. So i just have a question for all you moms out there. ive called several places and I have gotten no answers. my child's father wants to change my daughters last name to his last name. I am now married and my daughter has my maiden name. if i let him chnage her last name to his will that give him more rights or leverage? i just dont wanna go through with it and then end up regreting it if he gets power over me. he pays child support but there is no visitation established. he only sees her on the weekends. ? #myfirstpost
Don’t let him push you around. I agree with waiting until she’s older, and she can decide. From what you’ve said he has no right to claim her on his taxes, unless you give him permission. Since you have her more, I personally wouldn’t allow it.
I may be reading your posts wrong here but it looks like he wants to claim her on his taxes when you gave placement and pat for almost everything for her. Ummm no. And I agree it shohld be her choice when she's older. It sounds like he is trying to manipulate you and take money from you by claiming her on his taxes when you should be.
I would tell him, to just wait until your daughter is old enough to decide for herself if she wants his last name or keep yours. As far as claiming her as a dependent i wouldnt let him. She is under your care for most of the time.
Do what makes you feel comfortable, if you dont want to change it then don't. It seema hes just trying to threaten you with claiming her. If her having his last name is so special and important to him, he wouldnt be all, I wont claim her if you do this.
And claim her yourself, regardless if he makes more. You have her the majority of the time, you could use that money. He doesnt need it.
And if he does file for her as well, then more than likely they will side with you and give it to you.

Yeah well the reason I gave her my last name was because he wasnt there at first. And now he wants to change it. && it just worries me because I dont want him to have more power over me
@shelly_cheer1 Right? Totally get it. I personally wouldn't do it until you're officially ready to do it. Don't think he would but he might just take full advantage of it though.
If he isn't on the birth certificate then you would or he would need to get a lawyer so he can do the dna test then it would go to court to set up child support and visitation.
He is on the birth cirtificiate because he does pay child support but no visitation is in place we just decide on our own and communicate that.
@shelly_cheer1 okay got you. No I wouldn't change her name unless your ready too or see wants too. And if you are the primary parent then by law he can't. The child has to live with him for 6 months or you both agree on it
Yeah. the reason im asking too is because he wants to claim her on taxes he makes more than me I take care of her and he only gets her on the weekends I called child support they said it wasn't in my file about him claiming her. They still need proof of her birth certificate ss # etc . If he only gets her on weekends just don’t let him claim her . That has nothing to do with the last name situation though
@laniejay, not saying there’s necessarily an issue but if her dads actively in her life I dont see why she can’t / shouldn’t have it . She’ll be able to share a name with one of her parents lol

Keep in mind that you can change your name only limited amount of times on your social security card. This would be change number 1, out of 10 max per lifetime. If she wants to go back to your name or be legally adopted by your husband or whatever happens - those are other changes.
I simply wouldn’t do it. If she wants to call her by his last name - sure let me. Legally I wouldn’t do it.
