So I have my niece and nephew for holiday break. In my sisters custody agreement it states it was their fathers year to have them and it’s also his weekend. BUT he just strangled his girlfriend on Christmas Day and was put in jail just 3 days ago. We only found out because the girlfriend called crying and told my sister that it started over her finding drugs in his bag when he come home from work and she sent the report of his arrest. Of course she took him back and got him out of jail and now he’s just super angry at the world and not in the right state of mind. He’s been threatening to have the police go to her job and whoever has the kids will have to surrender them to the police. I honestly just don’t want to deal with the police, and tbh I don’t feel it’s safe to send children home with him when he’s in this state of mind overall. I guess my point in even posting this is if anyone who has a custody agreement knows if we would be FORCED to give the kids over since he technically can have them until tomorrow?

Very true. He doesn’t know who has them exactly but he hates me so badly that if he knew, he absolutely would do just that if he could.
@megannnnnb I only thought of that since we had an issue with my brother years ago. Our bio dad had him hidden at one of his sister's houses. It took my mom saying she would turn them all in to the cops for kidnapping and it's a federal charge.
She needs to call the court and file emergency papers. You technically cannot keep them as she's in contempt of a court order. I understand why, but she needs to take the appropriate legal steps
I agree. I’m 100% with her to do all we need to do so he can atleast be supervised. We don’t want to take the kids dad away completely because that will only hurt them in the end but he’s just not safe to be around them alone.
I'd call and ask them honestly. He's a danger to them imo.
That’s what I said to her. I’d call and ask but I’m thinking it would really be a civil matter and have to be handled in court anyway.

I'd have her call and ask. she'd have to go through the right people and file the right papers. I feel like since it's his weekend and the kids are with you, 1- mom would be in trouble for withholding them on his days because it's court ordered. And 2- how possible is it that he could turn YOU in for kidnapping since you aren't one of the parents. That was my first thought honestly.
