Question : I'm not married and I have a 12 month old. The father (my bf) and I gotina fight but I still let him use my car and take my daughter to his moms. And as he was driving out he said he wasn't coming back. He's On the birth certificate and she his last name (stupidly I did that) can he take her for days and days even if I say not too

It depends. In Georgia, the mother has full custody if you are unmarried until the child is legitimized by the courts and a custody order is established. Doesn’t matter if he signed the BC or not, the mother has custody and he can’t just take the baby and run off in this state.
Call and report your vehicle stolen because that’s exactly what it is if he’s refusing to come back.
@nicolem10021 it's different with your son because the father isn't on the birth certificate and paternity wasn't established. He has no rights in that situation. But with your daughter he's on the birth certificate so he has just as much rights as you do since no agreement has been made. It varies by state but most likely as of now your daughters father can keep her as long as he wants. If he refuses to give her back you'll have to go to court. This is why you always always always set up custody in court when you're not married.
He can take his daughter. He can’t take the car if it’s under your name. People fight but if he is not going to take it out on your daughter and will never harm her I wouldn’t worry. You thinking he doesn’t have right to do as he pleases as a parent because you are not married can go the same with you 🤷🏻♀️ just throwing that out there.
Exactly your not married there was never any custody agreement my husband and his ex were never married and cops have told us if it comes down to it we can take them and refuse to give them back until a judge or us decides otherwise and she can do the same with us she can take them and refuses to let us see them until otherwise
I have a son who's 9 and his dad isn't around but used to be in and out of his life. He trued taking him from me when he was 2. My son doesn't have his last name And I didn't put him on the birth certificate. I was told by a cop that he has no rights to do that until we go to court and set up an agreement. He can't just say no he's not being him home
@nicolem10021, it’s my understanding that both parents have equal rights unless indicated by a court order. Call your non emergency police line and explain the situation, that he took your car too. They will be able to tell you where to go from here.

Yes unfortunately he can. I’m sorry that’s so rough. You need to file custody right away and get this settled through court. You can report the car stolen though, I’m not sure how that would play out.
She has the same last name and he is on the birthday certificate he has the same amount of rights as you unless you go to court and there is a different order in place but if he is on the birth certificate he just needs a copy to show the cops and he’s fine there wouldn’t be no issue
