I seriously cannot wait to get the hell out of this apartment !!! We live in one bedroom, we’re moving in october ( we have to wait because of money situation) but if i can leave right the f*** now i will ! The landlord does not fix anything, theres a leak in my room thats on and off and there are whole on the ceiling from which roaches are coming from. My house is infested with roaches !! & i dont mean 1,2 or 3 i mean like hundreds of them & im 31 weeks pregnant & i have a 3 year old, this is stressing me out to the point where i cry.

Umm you need to call the health dept ASAP! They will force him to take care of it all. That’s not the kind of environment a kid or pregnant woman should be living in. The landlord should have more consideration and sympathy for you guys!! 😡 Please call the health dept!

In NY you can withhold rent until they fix your apartment

Ive called 311 plenty of times because of the leak and they send the fire department and tell me to contact the landlord, when i do contact the office, the buikding manager says that shes gonna send someone such and such date and they never show up. But now this roach problem started happening and i barely sleep because they are everywhere just crawling! @briealyus, Absolutely you can!! That’s a huge issue! Very unsanitary!
I would keep calling until they do something about it!
And you can most definitely withhold rent until the issues are fixed!

@briealyus, yeah, you can get a lawyer and withhold rent until they fix every single problem. (You HAVE to get a lawyer involved to withhold rent in escrow)
Your apartment conditions are 1)inhabitable which means your landlord is breaking your lease. 2) your landlord is breaking your lease which means you have 100% right to not pay your rent, or break your lease and move out without any penalty.
3) roach poop and pee can cause a plethora of problems, like respiratory problems and infections. They also bite and that’s how they transfer disease and infections. If not for you, do it for your children. You have a newborn on the way who could end up very very sick.

I had a major issue with my mom when she was my landlord, similar situation, she wouldn’t fix shit and I was paying rent. So I stopped paying rent, she called the cops on us (it’s so sad, I know) and the cops told her she needed to go to the court to get us out. Long story short is she never did it because she knew she would lose, to submit a motion you have to pay a certain amount but with what you have going on I would invest into that motion because you could be making a lot of money at the end of this because he shouldn’t refuse to fix things in your apartment, I’m sure that it’s in the lease and it’s his responsibility unless stated otherwise.

@leslyev, wow thats crazy & everyone is telling me that it makes no sense to take him to court or do anything because im moving october 10th but still thats a whole month that i have to deal with this bullcrap apartment !

It’s really up to you if you want to go through everything, but you are doing the right thing by moving, for your health as a family and so you don’t deal with that stress. I moved from my moms because it was just a bad environment for no reason.
In your situation I feel like you could do something about it, speak up so that horrible landlord can’t keep doing this kinda shit. You paid rent for the month you are staying ?
