There is no custody agreement I dont even know what that is. ?? He signed the birth certificate. Hes been in and out of Liams life for his whole life. Now he wants to take him when we break up... @ek620 @newlyironman @bebefever94 @blueballs

No he cannot. Your best bet is to get yourself to the courthouse and file custody paperwork ASAP.

He can’t do that. The police won’t do anything in this situation. Do not leave your son with him though because he’s under no legal obligation to return him to you. File for custody at the courthouse ASAP.

@julyfourthbaby, a custody agreement is a court order of who gets to have the child. If you don’t have one set then no he can’t take him

The law is that if there is no court ordered custody agreement, whoever has the child in their possession, has custody. So do not let him have the child, he won't have to give him back

@newlyironman Okay this makes me feel better. My BD and his mom called me saying they're coming with the police to take him. I didn't think they could and they kept saying yes we can yes we can

No he can’t just take him. I’d suggest you go file for full custody right away. And don’t let him have your son even if he seems like he’s tryna patch things up and promises he’ll bring him back home.

In the state of North Carolina (like most other states), if you are unmarried when you have a child, the mother is presumed to have primary custody until there is a court order in place. Do not give your child to him. Do not open the door.

The police deal with criminal matters, this is a civil matter. They’re just trying to scare you.

They definitely can't do that. Just keep your son glued to you. Don't let the dad near him. Go to the courthouse and file for a custody agreement. If anyone in his family tries to come get him (like his mother) while he is not there, can have kidnapping charges against them.

I would never want to keep my son from his dad, but his dad is NOT on child support. My son is 1! His dad has not bought 1 pack of diapers, toys, wipes...The ONLY thing he has bought my son is ONE container of formula from CVS when Liam was 1 month old. He lives in an awful neighborhood, he gang bangs, smokes, does drugs, as does his Mother. His mother just got 2018 cocaine charges. He, since August 2017 has gotten himself 9 misdemeanors and 1 felony. I bailed him out in May. Their house is full of smoke, bugs, no food, just dirty. I'm so lost!!!!

On top of it!!... My child's father BROKE INTO MY PARENTS HOME while my whole family was out of town! Stole priceless things from great grandmas, my dad's guns, a whole bunch of jewelry and money. Police involved, and everything. Never knew who it was! My BD made the mistake of telling his cousin, who told his aunt, who told me! He admitted to it, and nothing has happened to him.

@julyfourthbaby I would print off a copy of both of their records and go to the courthouse to try for restraining orders tbh. I grew up around that stuff my whole life and it is horrible for any child to be around.

@julyfourthbaby besides doing what these lovely ladies have said, I'd ring the police if your ex and his mother turns up. Lock all doors and shut all blinds.

I went through this many years ago. It was my stepchildren’s biological mother who was on drugs so my husband and I decided we could not return the children to her. We let her know they would be staying with us, so she called the cops and sent them to our house. The cops basically said there’s nothing they would do, it’s a civil matter. They had to come only because they were called. The bottom line is that if there is no custody agreement, whoever has possession of the kids is who has the rights. If you let your child’s father have him at any point, he could essentially decide not to return him to you.

As everyone else stated, he can't and the cops won't allow him to. Dnt let them scare you. I would file for custody as soon as possible and keep your son away from him until you have something in place through the courts.

No he can’t but like someone else said do not leave your son w him. The police will stay out of it unless there is violence involved or someone is violating a custody order.

Yes get u some no trespassing signs to put out side ur home get a restraining order and file for custody at ur family court and idk if you post alot on social media i wouldn't post my where abouts and i wouldnt post my work schedule or when im at work
