My baby father is trying to get full custody of our son but he just made a post on FB saying he having a smoke out at his his house there's going to be weed & alcohol remind you he still lives with his mother & he's under 21 . Weed is illegal in this state & the minimum age to drink is 21 can I use this as evidence to show to the judge ? & Can his mother get introuble for it as well ?

If the cops show up to the house during the party and the mother is there with underage kids drinking, she will get in trouble as well. Which will work in your favor because that shows how unfit they both are! No place for a child to live or even be around.

Use everything you got, fighting for custody is unfortunately a war. Smoking isn’t like a huge deal but when you’re trying to win a custody battle you probably shouldn’t be putting your business out there 🙄
@fuhgeddaboudit I was asking if she can get introuble because he's under the legal age to drink & she's also trying to help him get full custody so our son could live in a house where they drink & smoke all the time so

Yes you can definitely use it as evidence in court! Screenshot everything you can. If you want to take it a step further, call the police during the “smoke out” and act like a neighbor complaining about underage drinking or loud music, something along the lines.
My brother was in a similar situation with his BM (who is a very unfit parent). My brother called the cops to do a wellness check on her and they arrived to witness a heated argument between her and her boyfriend. Both got arrested and my brother was granted full custody immediately after.

It can be used against him, but for her to get in trouble she would have to be proven to knowingly allow it
