All the B.B. ladies that were following my story with Isabella’s dad and all the custody that I’m trying to get.
He has been seeing her now about once a week for the last 5 weeks, when he takes her he is completely turned around. He plays with her the whole time, feeds her, changes her, wakes with her during the night. He also checks on her and FT her throughout the week.
Should I still file for default custody since he never originally responded to my first summons? Or should I just let it be and continue with our arrangement?

I would still file. It’s great that he is stepping up now, but having it legal through the court protects all parties. What is the default custody? Full or primary?

File. You can keep things as is, but at least legally you have a leg to stand on if it goes south.

I'd still file. He's seeing her now, but what happens if he decides he wants more time or abandons her to play house again? I'd want everything covered and set in stone.

I agree with the others. Who knows how he going to be in a week or two?!? Ya know? Better be safe then sorry. I’m very happy to hear he’s stepping up and I really do hope that he continues to do so. He’s her dad that’s his job!!

I’m I’m Cali and if I do file for default that means I will go to court by myself for full sole and physical custody. He is not even involved in the court date. It’s up to the judge. The clerk told me ‘if everything goes smooth during court, you’ll be granted full custody’

@ss3mom, I wanna file for child support but I’m sooo nervous they won’t be able to prove he gets paid under the table. He’s been giving it to me every 2 weeks on he dot. He pays me $500 a month for just her and $250 to my mom to Baby sit her while I work.

@crai, yes he’s a grower at my uncles grow. My uncles grow is also illegal, so I’m stuck between getting less because they can’t prove his job, or risking my uncles business.

@crai, yes he actually wrote me a letter stating he gives me $500 in cash a month and signed it. Since then we’ve added the $250 so I will be having him hand write me a new one tonight. Thanks ladies y’all are the best

Honestly I wouldn’t touch the support issue. If you’re going for default custody it’ll show that he is stepping up and they may stop and think about it. If he’s paying you, leave it alone until he doesn’t. Then the courts can sort it out.

@kellyjc, I think once she got a little older it changed him? When she was a newborn she had BAD colic and screamed literally all day and all night. I’m in no way making excuses but I’m guessing that’s why? Idk anymore lol

Yeah I’d keep child support with him paying that amount and file if he stops. As for custody, I’d keep that going. That’s the most important one to address. I am being hypocritical, as I filed for child support 6 years ago and I’ve gotten it since, but my sons dad is absent. I haven’t filed for custody, as I’ve never seen him as a threat. He is not on my sons birth certificate so I don’t have to ask him for permission to leave the country or anything. @august.rae,
