Is it wrong for biological parents to want to establish a relationship/eventually regain custody 8 years after signing over custody at birth. (No adoption)
*biological parents were 16, drug addicted parents, circumstances have changed in child’s life (woman died and man remarried shortly after and is suspected to be on drugs and moved away from all “relatives” and friends and has isolated the child)
Are the biological parents in the wrong?
Noted biological parents now have two children of their own and a stable home.

I am a HUGE advocate for kindship care. If mom and dad get their shit together. Yes their child should be returned to them.
Rowdy Vajazzy·
This definitely should be dealt with in the courts, but I think the parents have a case. How old is the child now?
BunsInMyOven·
@squishymommy1, I agree. UNLESS the parents already waived all rights

Wait sorry reading comprehension issue on my part. It’s wrong. They went through the process. When the child is an adult the parents can then pursue a relationship... but there is a long lengthy process of gaining legal custody

Yes if they signed away their rights it’s final. I agree with phoebesmommy, they can pursue a relationship when the child is an adult.

@rowdy-vajazzy, 8
And no rights were signed away because the child wasn’t adopted just legal custody
Lostbirthmother·
He was supposed to be adopted they never did and now the “mother” has passed and dad has been “brainwashed” and went off the handle as told by people who are close to the custodial father

If the child is in an unsafe environment and it is determined they should be placed elsewhere by a judge then I wouldn’t see why placing with biological parents would be an issue BUT if bio parents just decided they want kid back and there is no good reason to uproot a child and pull him away from his family who raised him then hell no.
Lostbirthmother·
From what I’ve been told and seen on fb the custodial guardian is in a bad place.
Lostbirthmother·
Meaning the child is likely in a bad situation as well

Do the birth parents have a relationship with the child? Would there be a better placement with someone the child is even closer to, a grandmother figure perhaps?
I'm with whatever is in the best interest of the child.
Lostbirthmother·
@tbree121, no relationship and no grandparent figure

Does the child even interact or speak to parents on a regular basis?

Just because the legal guardian is unfit doesn’t somehow make the parents fit... even if they did go on to have more kids.

If the child is in an unsafe environment, then CPS needs to be called. If they deem the home unfit and the child needs to be placed somewhere else, then CPS should determine the best place. That doesn’t mean it’s necessarily with the birth parents. I am all for what is in the best interest of the child.

Yes, as a actual birth mother who placed my child for adoption at birth I would not uproot his life after 4 years. It's not fair for him and it would only disrupt his life even more. And believe me I want him back, and it breaks my heart Because my life is better now and I could take care of him now.
Maureen ·
I still have a relationship with him, but I wouldn't uproot his life unless he was in danger

In general, I would say yes. I don't think you get to abandon a child for 8 years and then uproot his life just because you're finally ready to deal with him. If the goal is to re-establish contact with the child, I think the bio parents would need to work with the child's custodial parents to determine what's best there.
If there's suspected drug use, call CPS. I don't think it's right to try to take custody back based on Facebook hearsay. If CPS determines the child should be removed, the bio parents should consult a lawyer about their options.

I don’t know that it’s wrong for wanting that but it’d be wrong to uproot this 8 year old child.

I’m a birthmom too and I would have 100% taken my kid back before they fucked him up if I had been legally able to. No question 🤷🏼♀️
