Vacations out of state and an absent parent
Vacations out of state and an absent parent
In May DD and I are taking a vacation with DF and the in laws to Florida. DDs father is absent and has been for quite some time. We have a court order that states I have full physical custody we have joint legal custody and visitation as we mutually agree. It doesn't state anything else in the agreement. Do I need to try and get his permission to take her out of the state (we are flying) to go on the plane or can I just bring the court order stating I have full physical custody? BTW we live in NY if that makes any difference.

So I shouldn't have any problems taking her out of state as long as I have my court order?
I feel the same way. DD and I have never had the same last name so I'm just paranoid something will go wrong ?

Ad far as Nevada and California go, yes, even for vacations you need his permission to leave the state.

My dad has taken dd out of state (from ca to Hawaii), without either parent present, three times with zero issues.

You shouldn't have a problem in the states flying. You just need your ID and your babies birth certificate.
