work?

I just got my final disability check in the mail. It says that they are not approving my extension of disability benefits. I will probably have to go back this weekend. I'm freaking out big time, I'm not ready. Baby is colicky, has reflux, gets up every 1 1/2 - 2 hours. Help me!!!

So sorry, this sounds terrible! My immediate thought is whether you can get a doctor to insist that you need to stay home w baby? Maybe on medical condition (colic & reflux) & baby needing your milk frequently? If you're in the U.S. The FMLA law protects your right to care for family & not lose your job.

On what basis did they deny the extension? Can you directly argue against that? Or is it that you're no longer disabled because you're no longer pregnant?

There's always the drastic last option of just not going back & figuring out how to afford that financially. Best of luck to you, my heart is really feeling for you.

Thanks so much for all the support!! You ladies are the best! My baby was born 6 weeks premature, he stayed in the nicu for almost 2 weeks. He's healthy thank God, but is having issues. We have been to the pediatric Gastro, pediatric ENT, his regular pediatrician. He's on zantac, tried, different formula, sleeps upright, burps after every ounce! And I have PPD. Disability said that PPD is not a sufficient disability, are they kidding me! For anyone who has gone through it, knows it not a joke! I looked up the FMLA, its only in effect in NJ , CA , and RI. I am in NY. Please pray for us. Please God give me strength!

That's not right about the states it's available in. I'm in Kansas and it's required here. It should be required everywhere if I'm not mistaken

I know the feeling!! I had to get back as well. It sucks!! It makes you feel like you're abandoning your baby.

Thank you so much, my heart is aching so bad right now, he's so little and being a premie and being in the nicu, I don't feel like I had enough time with him. Thank you for listening & commenting! It means a lot. I will definitely check into FMLA deeper tomorrow. God bless all of you!

Aww, that's heartbreaking. My employer said I could come back part time but I need the hours. FLMA did work for me because it is a small office. There are only about 6 employees, it works great for businesses that are 50+.

FMLA is available I thought country wide but there seems to be confusion as to what it does. Yes it holds a position comparable to you old one (it doesn't actually have to be the position you held), it also requires your employer to have 50 or more employees, for you to have worked a minimum amount of hours in the past 12 months, and it is inpaid.

A couple states have short term disability bennifits, however many you would already have had to sign up for bennifits and pay before even concieving.

My FMLA was denied because I didn't have enough hours for the past year & unless my doctor diagnosed me with medical issues than I would have more time off but since that's not the case I have to go back to work next Saturday. But I don't think I'm going back I don't want to leave my baby girl @6 weeks I just feel that she's too small for me to leave her. But I need to talk to my HR & see if I can get more time off & if I can't then I won't go back.

I'm in NY and I have 12 weeks fmla if I choose to use it. How long have you been at your job? The requirement to get fmla is you have to be at your job for a year before you can get it.

That's just awful. Can you fight it? I have to apply because it will take a year for my heart to heal. They say everyone gets denied and you can fight it. I know what it's like to be ill or in pain and want to work but not be able to or work and suffer. Especially now with a baby. Prayers and hugs

I think there is some confusion. FMLA and Short Term Disability benefits are two different things. FMLA is a federal program that allows you twelve weeks off if you meet the requirements. Nothing in the statute stipulates that you must be paid, just that you will be allowed to return to the same job when the twelve weeks are over. If you no longer qualify for STD, you can still stay home for twelve weeks under FMLA, you just won't be paid.
