My SO is currently awaiting his UVISA and just received his work permit and social this summer. He can to the US at the age of 3 and has been here ever since. If we were in your situation we would do what the lawyer said but only because we have a very sick daughter who is constantly hospitalized and he is our head of household. I stay home and care for my sick child and other babies. Also I saw that if it effects someone physiologically then that could help too. Which I suffer from serve depression and anxiety and I'm already seeking help for my my panic attacks when ICE came to Chicago and started deporting people. Message me if you have any other questions

Blueballs I believe didn't use advance parole I'm almost positive she used an i130 and 601a, I remember her commenting on my post about us being approved for i130 hers took 3 years to complete, advance parole doesn't let you submit a perdon (601a waiver) that's why it's risky
She submitted one.
What she's saying is once approved and consular appointment has been set in your country it's generally just under 3 weeks you'll be there then you'll enter & be granted permanent residency
I'm not sure why your lawyer suggested advance parole and not a spousal petition. Dh also thought daca and advance parole would be a good path to begin however our lawyer advised us that i130 and 601a waiver is a much sure and standing process to take, seek another opinion from another lawyer that specializes in immigration, many have free consultation.
Has your so been deported? A 601a waiver won't work if been deported and he re entered again as it's valid for only 1 entry, that's the only other reason I can think why you weren't advised to do a i130 & 601a petition in the first place.
@klazaro I am a citizen but my husband entered illegally and is now here through DACA. What's the difference between the parole & what blueballs did? Because everywhere I read it takes up to 2 years but she said it took them 3 days?

Advance parole is tricky and not a guarantee for re entry, advance parole is also dependent on tps which in your case is daca, daca at this point it's time ticking down, it's an executive order that can be revoked at anytime, the trump administration addressed revoking it once in office within months.
Are you a citizen or permanent resident? If so I believe blueballs and I are talking about the same.
Petition i130 & 601a waiver to re enter. It's not as fast as advance parole it's a nearly 2 year process or longer, and quite expensive but is the safest road if you're eligible. If you're not a citizen or permanent resident then I can see why your lawyer would suggest advance parole it's probably the only option at this point and if so you should file your applications soon as any chance is better than none, I'm almost certain there won't be another tps program implemented for those that were children residing unlawfully at least under the trump administration.
Blueballs so it is possible? It all seems sketchy to me. Did you have to do anything for it to be processed? Or did he do everything ?

Yea we did that but he actually got a letter or like a pardon? Like he had a certain amount of time to go and come back. We went to Mexico for three days and he came back in legally. So there was documentation on it. After that we went ahead and got his residency. He actually got his residence card about 6 months ago. Your husband can't leave just like that he must first get the letter from uscis saying he can come back into the United States.
That's what I'm terrified of. But he's so stubborn.

Nooo! I don't think that's a good idea ? if he gets out of the country he will lose his daca and is not for sure that he'll get the emergency visa, and now with trump as president i think it will be even harder to get any kind of visa
Yeah my husband has it or is a dreamer. Not sure how to express it. But I'm really worried with what his lawyer is suggesting. So I was wondering if anyone from here has gone through the process with their spouse or themselves ?
