What's so stupid is Dairy Queen throws away soooooo much of their goods every single night. A $2 cone wouldn't have made a difference ? what a batch! I would've told her it's not your sons fault that she didn't bother to tell you the machine was down before making the ice cream and he shouldn't have to suffer for it.

I’d contact management. Throwing it away was uncalled for. They didn’t have a sign up displaying the card machine wasn’t working. So technically it’s their fault for handing out goods without receiving payment first.

When I worked in a restaurant if someone's card didn't work and if they didn't have cash we would just go ahead and give it to them. No point on letting it go to waste. I wouldn't have taken his cone :/ what a batch. I would have asked to speak to the manager.
She could have cleared your order on the dine in and went to the drive threw side and placed the order to use the card machine that way. I remember I had to do that on a couple of occasions .
Eta: she could have manually typed it in also.
