Money help? Or bills?

I have a few questions regarding being sent to court or getting wages garnished on dhs side because of my debt.

Nope all debt can be garnished from wages and taxes, not just federal loans.

I thought only federal loans or state loans can garnish wages. Like student loans.

Depends on where you live. I live in Wisconsin and they can garnish your spouses wages if it marital debt. It's different by state though. Some states they can, some can't.

I agree with Kms. 9000 is not worth filing bankruptcy over. Call the people you owe money to and try to work it out. Get a part time job and apply that to your debt. Cut everything non essential out of your budget and apply that to your debt. Have your dh get a second job for awhile. Sell things you have around your house that you don't need. Filing bankruptcy should be an absolute last resort.

Yes it can affect his credit. Since the debt was incurred after you were married, what's yours is his. Unfortunately anything you do may impact your husbands score. However I would talk to a credit counselor about what they should suggest. Bankruptcy affects both people. You cannot file for it alone. Also they can withhold any tax refunds and potentially take from his wages depending on state.

I wouldn't absolutely NOT file bankruptcy over $9000.

Try a reputable credit counselor in your area. They can negotiate with the creditors to get the debt down and you can make reasonable monthly payments. A lot of creditors will settle with you and take off some of the money owed if you talk to them and try to work something out.

I wouldn't send any kind of payment, until the creditors can provide proof of your debt.

Would doing that bankruptcy affect his credit too?

Can you get a job that is opposite hours of your dhs? That way you can make money without having to pay for daycare.

Maybe it's time to think about bankruptcy? You can do Chapter 13 where you pay a small amount you can afford for a certain amount of time and the rest is thrown out. Your credit is already shot so it may be worth looking into it.

Pp's are wrong. They can absolutely garnish his wages for your debt. A friend of mine was sued and on the paperwork filed with the court it had her name and her husband's name, even though the debt was hers. If a judgement is given it will include him.

Was the debt incurred BEFORE you were married? That's the only way I see he could get out of it.

ETA- it actually said "her first last name AND John Doe (her last name) " because they didn't know if she was married. They added his actual name once she went to court and they asked for her husband's info. So, yes, they absolutely include spouses when they sue you.

No. The creditor can't garnish his wages because of you. They can only go after the defendant.

If they get a judgment against you, then can garnish or freeze your bank account. If the bank account is joint with your husband , then they will be able to freeze it.

I've gotten letters saying they will take me to court if I don't pay now. And the debt is bout 1.5 years old

As a previous PP stated from my understanding they have to first take you to court/get a judgement against you. Have you been served any papers or had any collectors threaten to sue you.

Also how old is this debt? Some states have a Statue of limitations of how old the debt is and how long they have to sue you. I would just do a quick google search of your state and credit card debt.

If you're married then they can and can also ruin his credit that's what happened to my coworker.

I'm not sure if they can garnish his wages, but technically if they did it wouldn't really be because of you. You're in this situation because of him having to have that money for a green card

Yes debt is only in my name. And by garnish wages like them just taking money out of his or our joint account.

they can get a judgement against you and garnish your joint bank account and take your tax return. They can't garnish his wages for your debt (I assume debts only in your name).

I dont understand garnished wages like if you dont pay and they take money from his check ?
