I would go file before he does. But even if you dnt, without proving you are an unfit mother the courts won't take her away from you. The most they would grant him would probably be partial custody.

I know a lot about it! If the birth father is on the birth certificate he has partial rights. But if you feel he is to unfit or being unsafe with her you can deny him to see her because police will not doing anything unless there is a custody agreement between the two of you.

@myboys1962, You’ll have to go to court and fight to get full custody. I understand your concerns completely though.

U need to get emergency temporary custody asap. It's best to file before he does. Make sure you have your stuff in order

@myboys1962 is that what you were told? I don't remember my husband needing those but I could be wrong. I also live in nc and not VA. Im from VA and my daughter's custody is from there so I believe you...I couldnt change her name without his signature and her birth father isn't even on her birth certificate!
