Child support question?!
Okay so my little brother who is now 20 had a baby with this older girl who has 3 children of her own. The girl is 28 years old! Each of her children have different fathers. Her oldest daughter which is 9 she does not have custody of due to drugs and prostitution. Any who.....my brother gets his daughter as much as she let's him which is only when he acts interested in the mother. She lives off of attention! He has been faking it so he can get her every weekend since they split. When he makes it clear that he don't want to be with her she holds the baby over his head. The baby is 1 1/2 and he is no longer with the mom bc she keeps getting caught cheating and doing prostitution. My brother has a very good job and makes good money for his age. He works hard and spends all of his extra time with his daughter. She does not work and he refuses to give her cash. He just buys the things she needs and sends it to her when he takes the baby back home after the weekends. Well since baby products dont pay her rent she is now taking him to court which is a huge mistake on her part and I doubt she will go through with it we think is is just acting thinking he will give her money which he isnt! but if not we will soon be taking her to court. ANYWAYS MY QUESTION IS: My brother would like as much custody as he can possibly get at least 50/50? Do they go by a certain schedule? How does child support work if its 50/50? How does this work in general? We have never delt with anything like this. TiA

They may grant him full custody if he tried being she doesnt work nor have income and he does.

Given that she has so many other kids with different men, doesn't work, and isn't suited to be a mother, I would say he has a good chance of getting full custody especially since he's working and stable

Document, document, document EVERYTHING. With proof he can get full custody, but if he doesn’t he will still have to pay child support i believe. I do know it is a set schedule one week with each alternating. If she’s not going by the original court order for visitation he needs to make a police report for records so when they go back to court because then she can get into trouble for it. Sorry it’s kinda long my parents had a nasty divorce while I was young and they kept taking each other to court until I was 18 so I know a few things 😂

Depends on the state
Most states will let father have full if he’s a better parent
Tell him to document everything he buys diapers keep the receipts & texts anything.
He he shows he’s providing for that baby judge will go easy on him instead of taking 70% of his check.
If he proves she’s unfit he can keep the baby & she’ll get her on weekends every other holiday instead of him only getting her on weekends

Like everyone has said document everything. Save every receipt he has where he has bought his daughter stuff. Make sure he is prepared to disclose his income, most recent tax return. Proof his home is clean and well maintained and baby proofed as well as his daughters room or sleeping area needs to be set up if it isn't already. He needs a lawyer for sure and print off any text messages where he asks to see his daughter and she denies him. Make sure everything is through text to have written proof. When he does go to court they may start off with 50/50 custody, but he may have to pay child support still if he is making more money then she is. But when taking the child back he can request for it to be in a public place if he would like. If she denies him his time file a police report. By brother went through this recently and his son will be 4 in November. He got full custody in may if last year
