So my last job fired me because I didn't come back after two weeks of having an emergency C-section to pull my daughter out. I filed for unemployment and have been under investigation because my last job stated I was a no-call no-show because I wasn't able to return after just two weeks and I didn't have an agreement with them that I was allowed to stay out for longer because they apparently had a business to run. Well the unemployment lady called me today and was talking to me asking why I didn't go back to work for them because they stated they would try and find me a different position to fill once I was cleared from the doctor. I told her that I was concerned because they weren't comfortable with the fact I was breastfeeding and would need to stop and pump for at least 10 to 20 minutes every few hours. The unemployment ladies voice change and she sounded as if she got mad and said well what job would let you stop and go pump in the middle of you working. When I told her that it's the law that employers give a breastfeeding woman a safe place that is not in public or in a bathroom to be able to go and pump when they need to it says if she got mad about that and then said well named one company that would let you do that. I told her about how my friend pumps every 2 hours for just 10 minutes and she works for call center and yeah she takes smaller lunches but they still let her go in pump so she can feed her daughter. And that I am not going to stop pumping or breastfeeding my child and it was if the lady got mad at this and in an angry tone of voice she said well we will make our decision and you'll know in 2 to 3 days what we decide. So now I have this horrible feeling that unemployment is going to deny me money just because I refuse to stop pumping and breastfeeding my child. I don't know about most people but my husband just got a brand new job on the other side of Texas we're getting ready to move anyways in the next few months so any job that I do get right now is a temp job which that's all I'm applying for and would be glad to have because we need the money and if I need the money so bad just to pay bills I'm not going to stop breastfeeding my daughter and add on having to buy expensive formula on top of everything else. It is so wrong that I now feel like she's going to punish me for breastfeeding my child and needing to be able to stop and pump and that she's going to deny me this money for me to be able to take care of myself and my daughter just because I said that I'm not going to stop using a pump and that I need a job that will let me stop and pump. I have done everything I know is right to do and I have followed all the instructions of the counselors and the lactation nurses up at the hospital and this is ridiculous and I feel like the interviews that I've already had that I told them I am a breastfeeding mother and need to be able to stop and pump they just told me that the position has been filled or that I didn't get the job... so it's not like I am not wanting to work! I am wanting to work so badly I'm willing to take almost anything right now, but I have to make sure that I have the ability to stop and pump when I need to pump so I can prepare bottles for my daughter so that away she's able to eat when I'm not around and I don't know why the unemployment lady felt like it was a bad thing that I want to be able to continue to feed my child! I have enough going on in my life and it's bad enough that I found out yesterday that my grandmother is dying from liver cancer and the cancer is now inoperable and they're switching her to hospice. Bills are getting really tight right now. My husband is on the other side of the State trying to finish the training for this new job. At this moment we have no money coming in whatsoever and I'm using the last of our savings to pay all the bills which doesn't leave any room for me to be able to get food for myself much less stopped breastfeeding and buy formula for my daughter. Ugh... why does this have to be so complicated and so hard for me??

I think she might have gotten the idea that youre not willing to work. Just let them know you are, dont say anything else anymore. If you end up getting a job that cant accommodate you then thats a different story.

@kambam that's the thing. I told her yes I do want to work and that I need to work. I've made that very clear to everyone ice talked to.

@vanessagarcia yeah. They knew I had an emergency c-section. I was on the phone with my job while i was in labor even. I also had to send unemployment all the proof that I had been in contact with my boss and the girl at the office during the entire time of me being out. And that was all during the month of June so why is it that I get an email on the 3rd of July stating that they replaced me as of June 17th even though I have text messages from my boss himself asking me about work questions after the 17th of June if I was supposed to have been terminated and replaced??

That sucks im sorry 😔they shouldn't be judging you or belittling you. I think you can request a new worker and report yours. If they do deny you I'd try again. It does hurt your case by not contacting your old job though

@kambam but that's the thing I had been in contact with him the entire time and they knew I was having complications with my c-section opening back up and I was going back to the hospital for it. They knew I needed more than just two weeks before I was going to be able to come back to work and they never told me anything other than take care of myself and let them know when I was available to work again.

Oh really? I wouldn't mention the pumping again if they ask why just say they weren't keeping in contact with you or being clear about your position

@kambam but it's the law for a company to give you a safe place to pump if you are pumping.

@kambam but if it's the law then why are they biyching about it?? It's the law!!! I mean God... you would think that a government institution like unemployment would understand and be ok with what the law that the government put in place is!

This doesn't make any sense and sounds highly illegal! When my job was being awful to me about being with my baby when she was so sick, I just quit and started my own business.

No food stamps.....apply for ebt food and cash of you get denied...plus you just had a baby...you should be able to take three months off ....
