So my husbands other sons mom took him to court for child support and full custody. On the custody papers she put he threatened to take the child if she filed... its a complete lie but can anyone tell me if that's gonna affect visitation or anything like that. Just trying to figure out why she would lie about that.
And also if the court reschedules because he's not on the birth certificate, if he doesn't get a paternity test by the next date will they automatically assume he's claiming the child? She claims they determine that at the next date and will only do a test if he requests it... but couldn't they have just done that right there and asked do you believe he is yours or not? It's for the state of New York. TIA

Her claims it really depends on the judge whether they believe her or will take it into consideration. As for paternity I can't speak 100% for ny but in most states they tell you to bring the child to the first appointment if dad isn't on the certificate. Then dad has the option to just sign a paternity waiver acknowledging he's the father. If he doesn't they usually do cheek swabs on the spot.

@keb5097 @beebaby, , ok I just don't necessarily trust her word after that lie especially.. the last thing we want to do is take her child away from her at all.. just want to make sure he has a right to see his child and as he gets older be able to have him on weekends or whatever so he could spend time with his brother (my son) and his father and do family things. So I don't really know where it all came from or why she would even say that. And as far as paternity his family was questioning it which made us question it. And I just feel like it's better to be safe than sorry at this point.
