Has anyone been involved in an interstate custody battle? I'm currently pregnant and the babies father who I am no longer with lives in Florida.. he believes that he will be able to get 50/50 custody of the baby once they are born. He has also threatened to get full custody and take the baby to Florida :(
I live in New York which is the state the baby will be born and would have jurisdiction over the custody case. How would a baby be traveling back and forth to Florida to have 50/50 custody ?
I live in Florida and my sister as well as several friends are divorced with children. 50/50 is always granted in Florida unless there are terrible circumstances happening that would be detrimental to the child (even with drug rehabilitation custody is not taken away). Not sure how it would be worked it between states, but the law and judges here grant equal custody unless one of the parents want less.
haha no that's not gonna happen especially for babies bc being with the mother is more important in the beginning. he's just talking out his ass
50/50 would be more so someone will have him summer months and someone will have him school months split holiday breaks thing like that. My brother lives in Delaware and his daughter lives in South Carolina and that's how their custody agreement was order. But she's also older now. Before he just had her bc her mom was in school full time and working. Once a order is in place it can't be changed for a set amount of time.
@ninamarie423, if he wanted the child during summer or holidays he would have to provide the transportation. which means he would have to drive or fly to u get the baby and then drive or fly back. I do know that a lot of judges now r makin it to b a equal drive on both parties but that is totally up to them
