there are many factors that play into this.. is he on the birth certificate? and in Florida in order to get court appointed supervision he has to pay child support. in the state of Florida the mother has complete control unless the dad has rights to the baby.. and even if he does have rights to the baby it all has to go through the courts..

@lesleyraesmommy, well he would first have to file through the courts to establish paternity, and then file to get visitation, and you could file through department of children and families your concerns with the girlfriend and she will have to prove to be fit to be around the baby and all... just forewarning you... this is a huge hassle.. I am going through something similar with my step son. his mother lost custody and we are fighting custody and all its just a pain in the ass. but you have full jurisdiction over the baby and no one besides the police/courts/dcf can make you let him see the baby. you DO NOT have to let him see the baby and absolutely do not have to let him take the baby out of your sight

If he's not on the birth certificate he legally has no attachments to your baby. If you think he would try doing something to you or the baby you can get a restraining order against him

@babyelkins2016, restraining orders are not that easy to obtain. He would first have to do something to the child to prove that one would be required. Everything depends on your state and the laws within it. Here if a baby is nursed the child is not allowed to be away from the mother for more than 2 hours at a time until 6 months of age. At that point if you're still nursing they require only daily visits. But again everything depends on the state and if the father even wants to be a apart of the picture. My sons DNA donor did not. So we waited 6 months with no contact and I filed for abandonment and terminated his rights to my son. I honestly would leave everything on him. Don't contact him, don't update him, don't file paperwork, NOTHING! If he is not on the birth certificate he will have to prove he is the father and at that point it's a 2-3 week process and you can file a parenting plan with stipulations that will not allow the gf to be around or require him to be supervised by someone you trust. If he argues you can go to court.

I live here in Kansas City and am going through the Jackson county courthouse. My husband and I currently have custody of his 6yr old and 4 yr old. He isn't on either birth certificate. The way Missouri works is even if he isn't on the BC if you have identified him as father he has rights. If you go to court they will first have an adjudication hearing for paternity. And go from there. I'm letting you know now this is a VERY lengthy process ! We've been fighting for sole legal sole physical custody for almost 3 and a half years. You need a lot to prove him unfit. They will most likely sign a GAL to the case which is basically a lawyer for the child. If you need help finding a lawyer who can represent you with a great standing record I recommend Henry Service.
