so my sister in law passed recently an her boyfriend won't let us see our nephew an is taking him out of state. I know for a fact he isn't a fit father is there anything I can do
unless there's proof that she said that then there isn't much that can be done. and it also would've had to be gone over with a lawyer that, that is what she wanted.
and if yaw don't want to go through all that, or have the money, yew can always talk to his parents to try to make him let yaw see your nephew
@kelseys, yeah I figured it'd be hard to do but before she passed she wanted to keep him away from this baby an was about to file full custody papers
more likely her because she's the grandparent. but like @chela said save all conversations. but then again because you aren't the baby's parent, he can legally keep anyone that he doesn't want around the baby away. but you can always try court to see if you can get visitation, which is really hard. even for grandparents its hard, because you have to prove that the parent is unfit, is single, the child has lived in the home(grandparent/family) for 2 or more years, and even then its hard to get it.
@kelseys, his mother is a teacher an will fight us back.. would they go with us or her since she's had him since she passed.
call dcfs(cps) and let them not he isn't fit and when they start the investigation and see he isnt fit the child's favor will to be with family.
@chela, the only evidence I have is that I saw him getting high at a party and he's always leaving him with his mother an never around he also told me he was sleeping in his car. I don't know if it's enough cause to go on other than the constant us trying to see him an him telling us to get fucked
