You can give your baby any last name right even if you're married? Does the husband have to go on the birth certificate or can the father go on the birth certificate?

@mylittleprincess, so even if the person I'm married to is NOT the father I can put the actual father on their and there be no problem? We've been separated for years just one of those things we never divorced.

correct. you can put whoever you want on there. the biological father has to be on the birth certificate if any child support is going to be collected.

The father should be on the birth certificate. And as a witness. My child's father is not on his birth certificate but we did a DNA test through the court and he pays child support. So whether its signed or not she can get child support. And with her being married she may still have to prove paternity, even though she know her husband is not the father of the child. Ive seen that done before also.
