You cant not send him back if she has custody what you can do is open up a case for temporary custody with concern for childs care with dept of children and families ur local police dept should have information but know opening this bag of worms there needs to be concerns for health well being this can not be a@personal matter between you two and the father would need to be willing to do this but if you only have visitation you can not keep the child away she can press charges if custody has been set up in court its hard you dont want to do anything to hurt your chance in the case that you would get the little one

Yea you have no choice but to send him back. Only a judge can say if you two are more stable. If she has custody of him then she can actually contact the police and say you guys are kidnapping the child. So I would just do it the legal way and file paper work.
