What would I need to do to take him back to court to get his rights taken!? Is there certain papers for that or what?

Last time we was in court the judge said he didn’t want to do that right then, because he wanted to see if Joe was gonna have anything to do with her.

Well it’s been three years since our last court hearing.

I think it’s time to take them, especially in case something was to happen to me so she wouldn’t go to him.

It really depends on the state. Most states won't terminate parental rights without MAJOR cause like child neglect or history of abuse. Or a step parent adoption... unfortunately being a deadbeat doesn't count in most courts because in their eyes he's still got another 14 years to show up

@brittanystewart304, ok. Bc I think they would make him do that first. But if he’s not paying then it shows he doesn’t want to be part of your child’s life.

@nikkim, the judge knows he doesn’t want anything to do with her. The last time we went to court I wanted them to just take his rights because she was already almost 2 and the judge said no because he wasn’t running in and out of her life. But since she will be 4 tomorrow, I think they should just take them. He has literally never even spoke to her before.

Well you can file abondonment depending on the state but I believe if there absent for a yr or more you can try and have his right taken other wise Someone could adopt them and he would legally have no rights mine pay and I did it

I believe you can petition a severance of his rights. I’d contact your attorney and see how to get the ball rolling.
