My sister needs to leave her cheating husband I told her she can up and leave without his permission since there is no parenting plan in place but shes still scared and worried something will end up biting her in the ass

Well since they are married, her making a decision unilaterally to leave with the kids can be a huge issue as he can immediately go to the court and seek a temporary restraining order which could prevent the children from leaving with her because the court can see it as making things unnecessarily hard on the children during an already difficult time, a divorce.

If she straight up leaves and takes the kids it will bite her in the ass! Unfortunately the issue needs to go through the court.

No it won't I did it then filed for divorce as soon as I left, who ever care they are in when u file they get to keep them until court date is set and finalized
