Did he sign the birth certificate? if so no one has sole legal custody until they go to court. But tell him to file asap. My husband is currently going thru the same thing. What part of Louisiana? I could tell y'all about some good lawyers
I have shared custody technically with my ex husband. On paper we have 50/50 responsibility, which means major medical decisions/school. He has Skype visitation twice a week and we rotate holidays and split summers. It has been like this since my daughter was 4 months old. We split transportation costs based on income. Which is 70/30. He pays 70/30 daycare in top of child support. My ex husband lives in Florida and I live in Mass. Our case is out of Florida because that's where we all resided at the time. Definitely have him consult a lawyer near him and then consult a lawyer where the child resides also.
Btw my ex husband was granted all of this visitation but has never really used it. The last time he saw my daughter was when we moved to Mass when she was 3 weeks old. Make sure he thinks long and hard about the visitation schedule he requests and follows through with all of it. A judge will not appreciate any parent asking for time and then not following through. Out of state visitation is very hard when they are babies but it can be done
@micgennyy of course! As long as he's a fit parent. There's no reason why he cant have joint legal custody and best case joint physical custody as well. Time may not be 50/50 depending on the age of the child, but as long as he's realistic about what is best for the child in a schedule.
@micgennyy he should file as soon as possible with proof of that. Luckily Louisiana has adopted the uniform child custody act, so joint custody is definitely on the table.
